May a relative of a person who has compiled textbooks act as a member of the Textbook Selection Council in Vietnam?

Under Clause 3, Article 4 of Circular 27/2023/TT-BGDDT regulating the selection of textbooks used in general education institutions in Vietnam:

Textbook Selection Council

1. The Textbook Selection Council of an educational institution (hereinafter referred to as the Council) is established by the Principal of the educational institution or the Director of the continuing education center, the Director of the vocational education - continuing education center, the head of educational institutions implementing the general education program, and the continuing education program at lower and upper secondary levels (hereinafter referred to as the head) to assist the head in organizing the selection of textbooks. Each educational institution establishes one (1) Council. For institutions with multiple education levels, each level establishes one (1) Council.

2. Number and structure of Council members

a) The Council includes: the head, the deputy head; the head of the professional team, the professional group, the professional department (hereinafter collectively referred to as the professional team), representative teachers, representative of the Parent Committee of the educational institution. The Council consists of an odd number of members, with a minimum of 11 (eleven) members. For educational institutions with fewer than 10 (ten) classes, the minimum number of Council members is 5 (five);

b) The structure of the Council includes: Chairman, Vice Chairman, Secretary, and Council members. The Chairman of the Council is the head; in cases where the head cannot participate according to the provisions of clause 3, Article 4 of this Circular, or in cases of absence due to force majeure, the Chairman of the Council is the deputy head. The Vice Chairman of the Council is the deputy head or the head of the professional team. The Secretary is selected from among the Council members.

3. Anyone who has participated in compiling textbooks or has directed the compilation, publication, printing, or distribution of textbooks (in the list of textbooks approved by the Minister of Education and Training); parents, parents-in-law, spouse; siblings and siblings-in-law of those who have participated in compiling textbooks or have directed the compilation, publication, printing, or distribution of textbooks; or those working in publishing houses or organizations with textbooks, are not allowed to participate in the Council.

Thus, parents, parents-in-law, spouse; siblings, and siblings-in-law of someone who has participated in compiling textbooks may not act as a member of the Textbook Selection Council.

Will the Division of Education and Training or the Department of Education and Training in Vietnam receive textbook selection dossiers?

Under Clause 5, Article 7 of Circular 27/2023/TT-BGDDT regulating the selection of textbooks used in general education institutions:

Process for Selecting Textbooks in Educational Institutions

1. The Council formulates a plan for organizing the selection of textbooks for the educational institution; assigns tasks to Council members.

4. The Council proposes to the head the list of textbooks that have been properly selected by the professional teams according to the provisions of this Circular.

5. The educational institution prepares the textbook selection dossier and submits it to the Division of Education and Training (for primary and lower secondary levels), and to the Department of Education and Training (for the upper secondary level). The dossier includes:

a) Decision to establish the Council by the educational institution;

b) Minutes of the Council meeting according to the regulations specified in clause 3 of this Article;

c) List of selected textbooks by the educational institution.

Currently, depending on the education level, the educational institution prepares the textbook selection dossier and submits it to the Division of Education and Training (for primary and lower secondary levels), and to the Department of Education and Training (for the upper secondary level).

What are the general regulations on textbook selection by schools in Vietnam?

Under Article 16 of Circular 27/2023/TT-BGDDT which sets out general regulations on textbook selection by schools in Vietnam:

- Organize textbook selection according to the regulations in Circular 27/2023/TT-BGDDT.

- Announce the list of textbooks approved by the Provincial People's Committee for use in educational institutions to teachers, students, and parents.

- Effectively utilize textbooks in the teaching and learning process; guide teachers, students, and parents on using textbooks according to regulations.

- Collect and compile any recommendations from teachers, students, and parents (if any) regarding adjustments or additions to the list of textbooks approved by the Provincial People's Committee, and report them to the Department of Education and Training (for upper secondary level) and the Division of Education and Training (for primary and lower secondary levels) before organizing implementation according to the regulations in this Circular.

- Be accountable to educational management agencies, students, and parents for organizing the selection of textbooks at the educational institution according to the provisions of Article 7 of Circular 27/2023/TT-BGDDT.

- Prepare budget estimates and submit them to the competent authorities for approval of the costs associated with organizing the textbook selection according to the regulations of the Law on State Budget 2015.
