What are the working principles of the Ministry of Education and Training of Vietnam?

Under Article 2 of the Working Regulations of the Ministry of Education and Training issued with Decision 355/QD-BGDDT in 2022, the working principles of the Ministry of Education and Training of Vietnam are as follows:

- The Ministry operates under a hierarchy policy, ensuring the principle of democratic centralism, and emphasizing the responsibility of the leader. All activities of the Ministry adhere to the provisions of the Constitution, the law, and the Ministry's working regulations. Officials, public employees, and employees within the Ministry's units resolve matters ensuring correct procedures, scope of tasks, authority, and jurisdiction assigned.

- The Minister primarily manages the unit's activities through the head of the unit. The unit leader is responsible to the Minister and the law for performing the unit's functions, duties, and assigned tasks.

- Each task is assigned to one unit to chair and be responsible to the Minister; in cases where a task involves multiple units, the unit most related to the professional work serves as the main chair. The unit head takes main responsibility for the quality, progress, and outcome of the assigned tasks.

- Each task of the unit can be assigned to one or more officials, public employees, and employees to handle, where a lead person must be identified. The person assigned as the focal point is responsible to the unit head for the quality, progress, and outcome of the assigned tasks.

For units with departmental structures: each task of the unit is assigned to one department to primarily execute; if a task involves multiple departments, the department most related to the work is designated as the main chair. The department head organizes execution and is responsible to the unit head for the assigned tasks; officials and public employees in the department perform tasks as assigned by the department head and are responsible to the unit head and department head for the outcome of the assigned tasks.

- The procedures, processes, and timelines for resolving tasks comply with legal regulations, the Ministry's working regulations, and according to the program and plan, except for emergencies or other requests from competent authorities.

- Ensuring democracy, transparency, clarity, quality, timeliness, and effectiveness in all activities; regularly implementing administrative reforms, and simplifying administrative procedures; building a professional, civilized, modern working environment; strictly adhering to public service culture regulations.

What are the responsibilities of the Ministry of Education and Training of Vietnam regarding state management of education?

Under Article 105 of the Education Law 2019, regulations on the education authorities are as follows:

Education authorities

1. The Government shall exercise the unified state management of education.

The Government shall consult the National Assembly on major guidelines that may affect learning rights and duties of citizens nation-wide, guidelines on reform of educational contents related to a whole educational level; annually report to the National Assembly on educational operation and educational budgetary execution; consult the Standing Committee of the National Assembly on large-scale application of new educational policies that have been successfully piloted when such application may affect learning rights and duties of citizens nation-wide.

2. The Ministry of Education and Training is accountable to the Government for the implementation of state management of preschool education, general education, higher education, vocational secondary education in pedagogy, pedagogical colleges and continuing education.

3. The Ministry of Labour – War Invalids and Social Affairs is accountable to the Government for the implementation of state management of vocational education, except for pedagogical vocational secondary education and colleges.

4. Within the scope of their duties and authorities, other ministries and ministerial-level agencies shall be responsible for cooperating with the Ministry of Education and Training, Ministry of Labour – War Invalids and Social Affairs to exercise the state management of education.

5. The People's Committees of all levels shall implement state management of education according to the Government's delegation and, within the scope of their duties and authorities, shall perform the following duties:

a) Reviewing the education regulatory compliance of local educational institutions;

b) Ensuring conditions concerning teachers, finance, infrastructure, libraries and teaching equipment of public institutions under their management;

c) Developing school types, conducting private sector involvement in education; meeting the demands of scale expansion, improvement of education quality and efficiency in their localities;

d) Implementing State guidelines, policies and local policies to ensure autonomy and accountability for the fulfilment of duties and education quality of educational institutions under their management;

dd) Be responsible for the results of the implementation of strategies, plans and policies on educational development at localities.

Thus, the responsibilities of the Ministry of Education and Training of Vietnam regarding state management of education are as follows:

- The Ministry of Education and Training is accountable to the Government for the implementation of state management of preschool education, general education, higher education, vocational secondary education in pedagogy, pedagogical colleges and continuing education

- Besides, within the scope of their duties and authorities, other ministries and ministerial-level agencies shall be responsible for cooperating with the Ministry of Education and Training, Ministry of Labour – War Invalids and Social Affairs to exercise the state management of education.
