1. The President of the commune-level People’s Committee shall issue a decision on establishment or permission for establishment of an independent early childhood education school.

2. Application:

a) In case of establishment of a public independent early childhood education school, the application includes:

A report on establishment of a public independent early childhood education school sent to the President of the district-level People’s Committee;

A written request for on-site inspection of fulfillment of requirements for establishment;

b) In case of permission for establishment of a non-public or private independent early childhood education school, the application includes:

A written request for permission for establishment of the non-public or private independent early childhood education school (according to Form No. 08 Appendix I enclosed with this Decree);

Copies of legal documents proving land use rights and house ownership or agreement on rental of location for the independent early childhood education school;

A legal confirmation document on the amount of investment in establishment of the non-public or private independent early childhood education school, ensuring legitimacy and conformity with the estimated scale at the time of establishment.

When will an independent early childhood education school in Vietnam have its educational activities suspended?

Under Clause 1, Article 12 of Decree 125/2024/ND-CP, an independent early childhood education school shall have its educational activities suspended in one of the following cases:

- It fails to meet one of the requirements specified in Article 10 of Decree 125/2024/ND-CP;

- It has committed any violation against regulations on imposition of penalties for administrative violations arising from educational activities to the extent that the decision on suspension thereof is issued;

- The decision on establishment or permission for establishment of the independent early childhood education school has been issued ultra vires;

- Its educational activities have not been conducted within the duration of 01 year from the date on which the decision on establishment or permission for establishment of the independent early childhood education school is issued;

How many preschool teachers are there for each independent senior kindergarten class in Vietnam?

According to Clause 4 and Clause 5, Article 14 of the Regulations on organization and operation of private independent daycare groups, independent senior kindergarten classes, independent nursery classes promulgated together with Circular 49/2021/TT-BGDDT, the regulations on organization of daycare groups, Senior kindergarten classes are as follows:

Organization of daycare groups, Senior kindergarten classes

1. Children in an independent nursery education institution are categorized into daycare groups or Senior kindergarten classes.

a) For daycare groups: Children from 03 to 36 months old shall be placed in daycare groups. The maximum number of children in a daycare group:

- Daycare group from 03 to 12 months old: 12 children;

- Daycare group from 13 to 24 months old: 20 children;

- Daycare group from 25 to 36 months old: 25 children.

b) For Senior kindergarten classes: Children from 03 years to 06 years old shall be placed in Senior kindergarten classes. The maximum number of children in a Senior kindergarten class:

- Senior kindergarten class from 3 to 4 years old: 25 children;

- Senior kindergarten class from 4 to 5 years old: 30 children;

- Senior kindergarten class from 5 to 6 years old: 35 children.

2. If the number of children in a category of daycare group or Senior kindergarten class is less than a half of the maximum number mentioned in points a, b clause 1 of this Article, then mix categories of daycare group or Senior kindergarten class provided up to 20 children in a mixed-category daycare group, up to 30 children in a mixed-category Senior kindergarten class, or up to 22 children in a mixed-category nursery class.

3. Each daycare group or Senior kindergarten class has no more than 01 child with disabilities who receives mainstream education.

4. If a facility has not enough children to place in a daycare group or a Senior kindergarten class as prescribed in this Article, the number of nursery teachers required shall be determined based on the average number of children by their ages of each category of daycare group or Senior kindergarten class, in specific:

- For daycare groups: 01 teacher shall be in charge of 03 children from 3 to 12 months old or 08 children from 13 to 24 months old or 10 children from 25 to 36 months old;

- For cenior kindergarten classes: 01 teacher shall be in charge of 11 children from 3 to 4 years old or 14 children from 4 to 5 years old or 16 children from 5 to 6 years old;

5. Each daycare group or Senior kindergarten class has at least 02 teachers.

Each independent senior kindergarten class has a minimum of 02 preschool teachers.

In cases where there are not enough children to arrange according to the stipulated Senior kindergarten classes, the preschool teacher quota will be calculated based on the average number of children according to each age group of each Senior kindergarten class as follows:

- For senior kindergarten classes: 01 teacher shall be in charge of 11 children from 3 to 4 years old or 14 children from 4 to 5 years old or 16 children from 5 to 6 years old;
