The school council is established and performs duties and powers in accordance with the Law on Vocational Education and some specific provisions as follows:

2. The number and composition of the school council members of the Pedagogical College are stipulated as follows:

a) The number of school council members must be an odd number, with a minimum of 15 people, including internal and external members;

b) Internal members include ex-officio members and those elected through the representative conference of the Pedagogical College.

- Ex-officio members include: the secretary of the Communist Party committee of the school, the principal, vice principals, chairperson of the Trade Union, and the secretary of the Ho Chi Minh Communist Youth Union of the school;

- Members elected through the representative conference of the school include representative lecturers (accounting for a minimum of 25% of the total number of council members) and representative public employees, laborers of the school.

What are the regulations on the operation of the school council of the Pedagogical College in Vietnam?

The operation of the school council of the Pedagogical College in Vietnam is regulated in clause 7, Article 9 of the Charter of the Pedagogical College issued together with Circular 23/2022/TT-BGDDT as follows:

(1) The School council meets at least once every 3 months and holds extraordinary meetings upon written request of more than 30% of total council members or written request of the principal or chairperson of the school council.

A meeting of the school council is valid when more than 50% of the total council members attend, including external members. The school council operates on a collective principle, making decisions by majority, unless the organizational and operational regulations of the university stipulate a higher voting ratio; decisions of the school council are expressed in the form of resolutions.

Minutes of the meeting and resolutions of the school council are sent to council members and the direct management agency of the school no later than 10 working days from the date of the meeting or resolution being signed for approval;

(2) The term of the school council follows the Vocational Education Law 2014.

The school council is allowed to use the seal and organizational apparatus of the school to carry out the works of the school council within the scope of its functions, duties, and powers;

(3) The chairperson of the school council receives an allowance equivalent to the principal’s position; the secretary of the school council receives an allowance equivalent to the head of the department; allowances for other members of the school council are stipulated in the organization's operational regulations and internal financial regulations of the school.

The operation funding of the school council, the position allowances of the chairperson, and secretary, and allowances for other members (if any) are stipulated in the school's organizational and operational regulations;

(4) Authorization to manage the school council

When the chairperson of the school council may not work during the period specified in the school's organizational and operational regulations, she/he must provide written authorization to one of the remaining council members to assume responsibility temporarily.

The authorization document must be notified to council members, sent to the direct management agency, and publicly announced throughout the school.

The authorization period and other related details must be specifically regulated in the school's organizational and operational regulations, ensuring compliance with current legal provisions.

- Requesting the principal to account for unimplemented, incorrectly, or incompletely implemented issues according to the school council's resolutions, if any. If the school council disagrees with the principal’s explanation, it shall report to the direct management agency of the school;

- Organizing performance evaluations of the school council’s chairperson, and council members periodically following the school's public employee performance evaluation cycle;

- Exercising other responsibilities and powers stipulated in the organizational and operational regulations of the Pedagogical College;

- Recommending competent authorities to approve supplementation, dismissal, or replacement of council members;

- Annually or unexpectedly reporting, explaining to the school's direct management agency, and state educational management agency the fulfillment of duties and powers of the school council.
