Based on Article 5 of Decree 86/2021/ND-CP on the recruitment and dispatch of Vietnamese citizens to study abroad:
- Standards for Vietnamese citizens studying abroad
+ Possessing good political qualities and ethics;
+ Not under disciplinary action or facing criminal prosecution;
+ Holding degrees, professional certificates, and language skills meeting the requirements of the scholarship program and other conditions as required by the scholarship program;
+ Having the approval of the direct management agency to study abroad (in cases where there is a work unit);
+ Complying with current regulations on training, fostering officials and public employees, and the rules of the Communist Party (in cases of officials and public employees and party members),
- Application dossier includes:
+ Official Dispatch from the direct management agency for applicant nomination (in cases where there is a work unit);
+ Commitment to fulfilling the responsibilities of the nominee according to the requirements of the direct management agency (in cases where there is a work unit);
+ Personal profile with photo and certification from the direct management agency (in cases where there is a work unit) or certification from the local government where residing (in cases without a work unit);
+ A certified copy of professional degrees, language certificates meeting the scholarship program's requirements;
+ Health certificate from a provincial or centrally run medical facility confirming the eligibility for studying abroad;
+ Other documents (if any) as required by the scholarship program and the dispatching agency.
- Procedure implementation:
+ Applicants submit 01 dossier set as specified in Clause 2 of this Article by mail, directly, or online to the dispatching agency;
+ Within 60 working days from the deadline for receiving application documents, the dispatching agency organizes the recruitment and announces the selection results to the applicants and the direct management agency (in cases where there is a work unit) through public notice on the agency's recruitment information portal.
- Responsibility for recruiting and dispatching Vietnamese citizens to study abroad
+ The Ministry of Education and Training conducts recruitment and dispatch of Vietnamese citizens to study abroad at educational levels within general, university, pedagogical college, and language training education funded by the state budget;
+ The Ministry of Labor, War Invalids, and Social Affairs conducts recruitment and dispatch of Vietnamese citizens to study abroad at vocational education levels (excluding pedagogical colleges) funded by the state budget;
+ Ministries, central agencies, People's Committees of provinces, centrally run cities, state agencies, state enterprises, public service providers conduct recruitment and dispatch of Vietnamese citizens to study abroad funded by the state budget;
+ The Ministry of Education and Training and the Ministry of Labor, War Invalids, and Social Affairs have the authority to delegate or decentralize tasks to affiliated agencies, units, universities, and vocational education institutions to implement recruitment and dispatch of Vietnamese citizens to study abroad funded by the state budget.
Ministries, equal-level bodies, People's Committees of provinces, centrally run cities have the authority to delegate tasks or decentralize to affiliated agencies and units to implement recruitment and dispatch of Vietnamese citizens to study abroad funded by the state budget;
Thus, according to regulations, good ethics are among the necessary conditions for students who receive foreign study scholarships from the state budget.

What are rights and responsibilities students learning abroad under the state-funded scholarships of Vietnam?
Based on Article 6 of Decree 86/2021/ND-CP regulating the rights and responsibilities of students abroad receiving state-funded scholarships:
- Rights of students with state-funded scholarships
+ Allowed to return home for internships, gather materials for educational purposes; entitled to vacations during the study period as prescribed by the foreign educational institution; allowed to return home or visit relatives in another country (third country) if agreed by the competent authority of the host country;
+ Entitled to consular protection and lawful rights protection from Vietnamese representative agencies abroad during the study period;
+ Entitled to full or partial coverage of training costs, travel expenses, living allowances, and other related costs for studying abroad from the state budget or covered by the foreign side.
- Responsibilities of students with state-funded scholarships
+ Strictly comply with Vietnamese laws, laws, and customs of the host country; in cases of violation, depending on its nature and severity, will be handled according to the legal provisions of the relevant parties;
+ Strictly comply with the rules and regulations of the foreign educational institution and commitments, rules of the direct management agency (in cases where there is a work unit), and dispatching agency; maintain and develop friendly relationships with organizations, individuals, and the local community in the host country;
+ Register as a Vietnamese citizen abroad according to current regulations and update information in the Database System;
+ Not allowed to leave the study program arbitrarily; comply with the study period, training level, field of study, country of study, and educational institution according to the competent authority’s study dispatch decision;
+ Notify the dispatching agency 10 working days in advance before returning home for internships, gathering materials, taking study breaks, or holiday breaks as prescribed by the foreign educational institution for students;
+ Send study progress reports (Form No. 01) and certified copies of study results from the foreign training institution by mail, directly, or online to the dispatching agency after each semester, academic year;
+ Must reimburse training costs according to regulations if failing to fulfill the study obligations or comply with the assignment of work by a competent state agency after graduation;
+ Implement current regulations on officials and public employees and the rules of the Communist Party (in cases of officials, public employees, and party members);
+ Protect state secret documents and information as prescribed in the Law on State Secret Protection and information on protecting internal politics;
+ Do not exploit studies or any other form to conduct propaganda activities against the state of Vietnam that may affect diplomatic relations between Vietnam and the partner country.

Are scholarships funded by foreign parties considered state-funded scholarships in Vietnam?
Based on Clause 1, Article 3 of Decree 86/2021/ND-CP regulating students receiving state-funded scholarships:
- State budget scholarship students are Vietnamese citizens studying abroad who receive full or partial funding for training costs, travel expenses, living allowances, and other costs related to studying from one or multiple sources from the following financial resources:
+ state-funded scholarships provided within the framework of agreements, cooperation agreements between the Government of Vietnam and the foreign government;
+ state-funded scholarships provided through state agencies, state enterprises, public service providers;
+ Scholarships sponsored by a foreign government, official development assistance (ODA), local government authorities, international organizations, non-governmental organizations, or individuals through the Government of Vietnam (hereafter collectively referred to as scholarships funded by the foreign party).
Accordingly, state budget scholarship students refer to Vietnamese citizens studying abroad who receive full funding for training, travel, living costs, and other related costs to studying.
Furthermore, scholarships funded by foreign parties specifically refer to scholarships sponsored by foreign governments, official development assistance (ODA), local governments, international organizations, non-governmental organizations, or individuals through the Government of Vietnam.
Therefore, scholarships funded by foreign parties are a form of state-budget scholarship sponsorship.
