In which cases are undergraduate students in Vietnam forced to leave school?
Based on point a, clause 3, Article 11 of the Regulation on undergraduate education, issued together with Circular 08/2021/TT-BGDDT:
Handling of credit-based academic performance
1. At the end of each main semester, students will receive an academic warning in any of the following cases:
a) Total number of failed credits in the semester exceeds more than half of the number registered for the semester or total number of failed credits from the beginning of the course is more than 24;
b) Semester average grade is under 0,8 for the first semester of the course or under 1,0 for following semesters;
c) GPA is under 1,2 for first-year students, under 1,4 for second-year students, under 1,6 for third-year students or under 1,8 for the following years.
2. Students will be forced to leave school in any of the following cases:
a) Number of academic warnings or level of academic warning received exceeds the permitted amount/ level according to regulations of the training institution;
b) Study duration exceeds the amount of time mentioned in Clause 5 Article 2 of this Regulation.
3. Training institution regulations shall provide for the following matters:
a) Application of some conditions for academic warning and permitted number of academic warnings or academic warning level, which shall allow for no more than 2 consecutive warnings;
b) Procedures for academic warning and forced leave from school; and announcement of such measures to students;
c) Retention of accumulated study results in case of forced leave from school.
Thus, undergraduate students are forced to leave school in the following two cases:
[1] Number of academic warnings or level of academic warning received exceeds the permitted amount/ level according to regulations of the training institution;
[2] Study duration exceeds the amount of time mentioned in Clause 5 Article 2 of the Regulation on undergraduate education, issued together with Circular 08/2021/TT-BGDDT. To be specific:
- Maximum time limit for students to complete a course shall be stipulated in the training institution regulation but shall not be longer than twice the study duration according to the standard learning plan for the whole course for each mode of study.
For students who take bridge programs and whose accumulated credits have been accounted for, maximum time limit for them to complete a course shall be determined by deducting the amount of study time corresponding to the completed academic load from the study duration according to the standard learning plan of the whole course.

Shall undergraduate students under academic warning be suspended for continuing to commit acts prohibited for students in Vietnam?
Based on clause 1, Article 9 of the Regulations for student affairs in formal higher education programs issued together with Circular 10/2016/TT-BGDDT:
Forms of discipline and details of violation
1. Violating students may, depending on the nature, extent and consequence of their violation, receive warnings, reprimands or may be subject to one of the following disciplinary actions:
a) A disciplinary action represented in the form of reprimand shall be imposed on students who commit less serious violations for the first time;
b) A disciplinary action represented in the form of warning shall be imposed on reprimanded students who continue to commit violations, or those who commit less serious violations in a continual manner, or those who commit violations for the first time which are relatively serious;
c) A disciplinary action represented in the form of fixed-term academic suspension shall be imposed on students who breach rules and regulations or commit serious violations against regulations on student's prohibited acts during the warning period; those who contravene laws and are subject to a suspended sentence. As the case may be, Heads of higher education establishments may consult training rules to make decisions on the suspension term, i.e. the term of one semester, one academic year or the term the same as the suspended sentence period.
d) A disciplinary action represented in the form of forced expulsion shall be imposed on students who continue to breach rules during the fixed-term suspension period, or commit violations for the first time which have extremely serious nature or level and cause adverse effects on their higher education establishments and society; those who contravene laws and serve jail sentences.

Thus, undergraduate students under academic warning who continue to commit acts prohibited for students, as per Article 61 of the Higher Education Law 2012, will receive a disciplinary action in the form of fixed-term academic suspension.
Are higher education institutions required to inform the family if a student is imposed with forced expulsion in Vietnam?

2. A disciplinary action which is at least a warning must be recorded into student administration documentation and informed to student's families. Where students are subject to fixed-term suspension or expulsion, higher education establishments must inform local authorities and student's families for their coordination in supervision and education of these students.
3. Details of violation and disciplinary framework shall be prescribed in the Appendix hereto attached.
Thus, if an undergraduate student is forced to leave school, the higher education institution must notify the local government and the student's family for coordinated management and education.
