Under Article 3 of Circular 24/2020/TT-BGDDT, the employment of unqualified teachers in Vietnam is specified as follows:

- In 02 (two) consecutive years preceding the year of entry in force of Circular 24/2020/TT-BGDDT, a teacher who has obtained at least qualified teacher status or has their performance of duties classified as at least satisfactory (through a quality classification of public employees), and still attains fitness to work will be placed a teaching post until retirement as prescribed.

- In 02 (two) consecutive years preceding the year of entry in force of Circular 24/2020/TT-BGDDT, a teacher who has not obtained at least qualified teacher status or has their performance of duties classified as unsatisfactory (through a quality classification of public employees) may not be placed a teaching post and shall be provided for a training course to do another job in the educational institution until retirement as prescribed.

- Teachers who are unfit for work, wish to retire and fully meet the requirements prescribed by the Law on Social Insurance may retire according to law.

- Unqualified teachers prescribed in clauses 1, 2 and 3 hereof, as the case may be, may be subject to severance or cutting down of personnel on payroll as per the applicable law.

What are the current standardized educational qualifications of teachers in Vietnam?

Under Article 72 of the Education Law 2019, the current standardized educational qualifications of teachers in Vietnam are defined as follows:

- Teachers of preschool education teachers must possess at least a pedagogical college diploma;

- Teachers of primary education, lower secondary education and upper secondary education must possess at least a bachelor’s degree in pedagogy training.

In case a subject is yet to acquire enough teachers with bachelor’s degree in pedagogy training, teachers of this subject must possess a bachelor's degree of suitable specialization and a certificate of pedagogy training;

- Lecturers of higher education must possess a master’s degree; lecturers teaching or instructing master or doctor’s theses must possess a doctoral degree.

- Standardized educational qualifications of teachers working in institutions of vocational education shall follow regulations in the Law on Vocational Education 2014.

In addition, Article 54 of the Law on Vocational Education 2014 stipulates the qualifications for teachers teaching at vocational education institutions as follows:

- An educator at elementary-level must obtain at least a degree of vocational secondary schools or a certificate in vocational skills used for teaching elementary-level.

- An educator teaching theory at intermediate-level must obtain at least a bachelor’s degree; an educator teaching practice at intermediate-level must obtain a certificate in vocational skills used for teaching practice at intermediate-level.

- An educator teaching theory at college-level must obtain at least a bachelor’s degree; an educator teaching practice at college-level must obtain a certificate in vocational skills used for teaching practice at college-level.

- An educator teaching both theory and practice at intermediate-level or college-level must achieve acquire qualifications equivalent to qualifications of the educator teaching theory and educator teaching practice as prescribed in Clause 2 and Clause 3 of Article 54, Law on Vocational Education 2014.

- Any educator obtaining no college degree in pedagogy, college degree in technical pedagogy or bachelor’s degree in pedagogy, or bachelor’s degree in technical pedagogy is required to obtain a certificate in pedagogy.

- The Head of vocational education authority in central government shall regulate the content of training programs, improve vocational skills and certificate in vocational skills used for teaching practice at all levels; content of pedagogical proficiency course provided for educators in the vocational education institution.

What are the regulations on educational institutions performing the duty of educating and training teachers in Vietnam?

Under Article 74 of the Education Law 2019 on performing the duty of educating and training teachers in Vietnam:

- Educational institutions performing the duty of educating and training teachers include pedagogical schools, educational institutions with faculty of pedagogy, educational institutions authorised to educate and train teachers.

- Educational institutions performing the duty of educating and training education managers include pedagogical schools, institutions of higher education with faculty of educational management, educational institutions authorised to educate and train education managers.

- Pedagogical schools established by the State to educate and train teachers and education managers shall be given priority in teacher recruitment, allocation of education managers, investment in infrastructure and dormitories, as well as availability of funding. Pedagogical schools have schools or establishments for trainee-teachers' practice.

- Within the scope of their duties and authorities, the Minister of Education and Training and Minister of Labour - War Invalids and Social Affairs shall stipulate the performing of the duty of educating and training teachers and education managers, and stipulate educational institutions authorised in educating and training teachers and education managers.
