How to handle teachers violating university enrollment regulations in Vietnam?
Pursuant to Article 27 of the Regulation on university admissions and preschool pedagogy college admissions issued together with Circular 08/2022/TT-BGDDT:
Violation Handling
- Officials and candidates who commit violations during the examination organization process shall be handled according to the regulations in the High School Graduation Examination Regulations of the Ministry of Education and Training (MOET).
- Candidates committing fraud during the application, exam to be admitted; depending on the level, may be expelled, banned from applying to educational institutions in the following years, or criminally prosecuted according to the law.
3. Individuals violating this Regulation employed as officials and public employees, depending on the severity, will be handled by the staff management agency as per Article 71 of the Law on Higher Education; Law on Public Employees, Law on Officials and related legislations on handling public employee, officials discipline.
- Individuals violating this Regulation who are officials, lecturers, teachers, and regular staff of private educational institutions, not officials and public employees, the principal of the educational institution is responsible for handling according to the provisions of the Labor Code and related legal documents.
- Educational institutions violating admission procedures, depending on the severity, will be handled according to the current law. The principal, chairman of the admission council, and related individuals of the violating educational institution will also be handled per the relevant laws.
- The institution's admission regulations detail the handling of violations for individuals and organizations involved in the admission process.
According to Article 52 of the Law on Public Employees 2010, the forms of discipline for public employees are detailed as follows:
Forms of Discipline for Public Employees
1. Public employees violating the law during job execution, depending on the nature and severity of the violation, must undergo one of the following disciplinary forms:
a) Reprimand;
b) Warning;
c) Demotion;
d) Dismissal.
- Public employees disciplined under one of the forms in Clause 1 of this Article may also be restricted from practicing their profession according to relevant laws.
- The form of demotion only applies to managing public employees.
- The disciplinary decision is recorded in the public employee's file.
- The Government of Vietnam stipulates the application of disciplinary forms, processes, procedures, and authority to handle discipline for public employees.
Thus, teachers who violate university admission regulations and are public employees will be disciplined depending on the nature and severity of the violation, and must undergo one of the following disciplinary forms:
- Reprimand;
- Warning;
- Demotion;
- Dismissal.
Teachers who violate university admission regulations and are not public employees, the principal of the educational institution is responsible for handling according to the provisions of the Labor Code 2019 and related legal documents.

Pursuant to Article 23 of the Regulation on university admissions and preschool pedagogy college admissions issued together with Circular 08/2022/TT-BGDDT, the responsibilities of high schools in university admissions are:
- Review, check and update personal information, high school academic results data of candidates in the sector database system;
- Cross-check data, guide candidates to correctly fill in information, including area and priority group information;
- Support registration of preferences for candidates without online registration conditions.
What are responsibilities of 12th-grade homeroom teachers in student evaluation in Vietnam?
Pursuant to Article 20 of Circular 22/2021/TT-BGDDT, in evaluating students, 12th-grade homeroom teachers have the following responsibilities:
- Assist the Principal in managing student evaluation in compliance with regulations.
- Confirm corrections of marks, assessment levels by subject teachers; aggregate students' conduct and academic performance results of each semester, the entire academic year in the Student Monitoring and Evaluation Book (by class), Student Report Book.
- Evaluate the conduct results of each semester and the academic year of students; draw up the list of students eligible to advance to the next grade, re-evaluate subjects, conduct during the summer break, those not eligible to advance, and those eligible for rewards.
- Record or input evaluation results of each student into the Student Monitoring and Evaluation Book (by class), Student Report Book:
+ Comments on training and study results of students; assessment levels of students' training and academic results.
+ Results of advancement or non-advancement to the next grade; recognition of completion or non-completion of the middle school or high school program; rewards.
- Guide students to self-assess during the training and study process. Collaborate with subject teachers, Ho Chi Minh Young Pioneer Organization, Ho Chi Minh Communist Youth Union, Class Parent Representative Committee, and relevant agencies, organizations, and individuals to educate students and receive feedback about students' training and study process.
- Inform parents individually about their child's training and study process and results.
