Based on Article 3 of Joint Circular 07/2013/TTLT-BGDDT-BNV-BTC, the regulation is as follows:
Principles for Calculating Overtime Pay
1. The monthly salary, which is the basis for calculating overtime pay for educators, includes salary according to the current rank and grade, salary allowances, and the reserved differential coefficient (if any).
2. The teaching hour norm per year for preschool teachers; the teaching period norm per school year for primary and secondary school teachers; the teaching hour norm per school year for professional secondary school teachers; the standard teaching hour per school year for vocational instructors and lecturers; the standard teaching hour per year for lecturers at higher education institutions, training centers, ministries, equivalent agencies, government agencies, and provincial/central political schools is uniformly called the annual teaching hour norm.
3. The school year stipulated in this Joint Circular is calculated from July of the previous year to the end of June of the following year.
4. For educators working at public education institutions with multiple educational levels and vocational training levels, the highest teaching hour norm is applied to the education level and vocational training level that the educator directly teaches as assigned by the head of the education institution.
5. The preparation, payment, and finalization of overtime salary funds are carried out according to the regulations of the Law on State Budget. Public education institutions stipulated in Clause 1 Article 1 of this Joint Circular, based on specific conditions of each unit, shall make payment or advance overtime salaries on a monthly or semester basis as appropriate.
6. Overtime salaries are only paid at units or departments lacking the number of educators approved by authorized levels. Units or departments that are not short of educators shall only be paid overtime salaries when educators are on sick leave, maternity leave as stipulated by the Law on Social Insurance, or away for education, training, inspection, and participation in other tasks (hereinafter collectively referred to as performing other duties) assigned or mobilized by authorized levels, necessitating another educator to substitute.
7. Time not directly involved in teaching but counted toward the completion of the required teaching hours and included in converted teaching hours, encompasses: sick leave, maternity leave as stipulated by the Law on Social Insurance; time spent performing other duties assigned or mobilized by authorized levels.
8. Overtime teaching hours eligible for overtime pay as stipulated by this Joint Circular shall not exceed the additional working hours stipulated by law.
Thus, the monthly salary serving as the basis for calculating overtime pay for public preschool teachers includes: the base salary, current rank and grade salary, salary allowances, and the reserved differential coefficient (if any).

- Annual teaching hour norm for preschool teachers = (Number of hours teaching children for two sessions/day) x (Number of working days/week) x (Number of teaching weeks/school year);
- Annual teaching hour norm for principals and vice-principals at preschool education institutions = (Number of hours directly participating in educational activities/week of the principal, vice-principal) x (Number of teaching weeks/school year);
- Annual teaching hour norm for primary and secondary school teachers; vocational elementary teachers = [Teaching period norm (standard teaching hour)/week] x (Number of teaching and educational activity weeks/school year);
- Annual teaching hour norm for principals, vice-principals; teachers serving as Young Pioneer Organization Advisors; teachers serving as Youth Union and Student Union officers in general education institutions = (Teaching period norm/week of the principal, vice-principal; Young Pioneer Organization Advisors; Youth Union, Student Union officers) x (Number of teaching and educational activity weeks/school year);
- Annual teaching hour norm for vocational education managers is the minimum standard teaching hour stipulated at Point b Clause 3 Section II and Point b Clause 3 Section III of Circular No. 09/2008/TT-BLDTBXH.
The annual teaching hour norm for professional secondary school management staff is the teaching hour stipulated in Clause 2 Article 8 of Decision No. 18/2007/QD-BGDDT;
- Annual teaching hour norm for other subjects decided by the head of the unit for each school year according to the documents stipulated in Points a, d, dd, e, f, g, h Clause 1 Article 2 of this Joint Circular.
