How many years of uncompleted tasks will lead to a reduction in staffing for teachers in Vietnam?
Based on Clause 1, Article 2 of Decree 29/2023/ND-CP, regulations concerning subjects subject to reduction in staffing policies are as follows:
Subjects subject to reduction in staffing policies
- Officials and public employees; commune-level officials and individuals working under indefinite-term labor contracts in administrative agencies are subject to policies similar to officials as stipulated by the Government of Vietnam, if they fall into one of the following cases:
a) Redundant due to review and reorganization of organizational apparatus, personnel according to decisions of competent authorities or redundant due to the public service provider arranging organizational apparatus and personnel to implement the autonomy mechanism;
b) Redundant due to reorganization of district or commune-level administrative units as per decisions of competent authorities;
c) Redundant due to restructuring of officials and public employees according to job positions, but unable to assign suitable alternative jobs or able to assign different jobs but individuals voluntarily agree to reduction in staffing and are approved by the organization managing them directly;
d) Do not meet the training standards for the professional and capacity requirements of the current job position, and cannot be repositioned to a suitable job or retrained to meet professional criteria, or are offered a different job but individuals voluntarily consent to reduction in staffing and gain approval from the managing organization directly overseeing them;
dd) Over two consecutive years immediately preceding the reduction in staffing review period, an official or public employee has achieved a performance rating of task completion in one year and task non-completion in another year but cannot be assigned a suitable job; or in the year immediately preceding or during the year of reduction in staffing consideration, they achieve a performance rating of task completion or lower but voluntarily agree to reduction in staffing and gain approval from the managing organization directly overseeing them;

Thus, teachers who, over two consecutive years immediately preceding the reduction in staffing review period, have one year with a performance rating of task completion and another year with task non-completion but cannot be assigned a suitable job are eligible for reduction in staffing.
Additionally, teachers are subject to reduction in staffing if, in the year immediately preceding or the year of reduction in staffing consideration, they have a performance rating of task completion or lower, voluntarily agree to reduction in staffing, and are approved by the managing organization directly overseeing them.

What are principles for reduction in staffing for teachers in Vietnam?
According to Article 3 of Decree 29/2023/ND-CP, principles for reduction in staffing for teachers in Vietnam are stipulated as follows:
- Ensure the leadership of the Vietnam Communist Party, promote the oversight role of political-social organizations and the people during the process of reduction in staffing.
- Link reduction in staffing with the organization of the apparatus in a streamlined, effective, and efficient manner, restructure and enhance the quality of officials and public employees according to job positions, in line with the autonomy mechanism of the agency, organization, or unit.
- Ensure democratic, objective, fair, public, transparent principles as per the law.
- Ensure prompt and full payments of streamlining policies and benefits as per legal regulations and ensure the effective use of the state budget.
- The head of the agency, organization, or unit is responsible for the results of reduction in staffing under the authority given to them.
- The individuals subject to reduction in staffing, if elected, recruited again into agencies, organizations, or units using the state budget within 60 months from the date of reduction in staffing, must repay the received allowances to the agency, organization, or unit that disbursed them.
Are teachers on maternity leave in Vietnam subject to reduction in staffing?
According to Clause 1, Article 4 of Decree 29/2023/ND-CP, the regulations concerning subjects not yet subject to reduction in staffing are as follows:
Subjects not yet subject to reduction in staffing
- Individuals currently pregnant, on maternity leave, or raising children under 36 months old, except in cases where individuals voluntarily agree to reduction in staffing.
- Individuals under consideration for disciplinary actions, or criminal charges, or those being inspected or examined due to signs of violations.
Thus, female teachers on maternity leave are not subject to reduction in staffing.
