How many days off are contractual teachers in Vietnam entitled to for the Gregorian New Year?

Under the provisions of Article 112 of the Labor Code 2019 on public holidays:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

Additionally, Article 1 of Decision 2045/QD-BGDDT 2024 stipulates as follows:

Issuing the  Plan Framework for the 2024 - 2025 Academic Year for Preschool Education, General Education, and Continuing Education applicable nationwide as follows:

1. Earliest school start date is 01 week before the opening ceremony. Particularly for grade 1, the earliest school start is 02 weeks before the opening ceremony.

2. The opening ceremony will be held on September 5, 2024.

3. The first semester must be finished before January 18, 2025; the program must be completed and the academic year must be ended before May 31, 2025.

4. Assessment of primary education completion and acknowledgment of lower secondary graduation before June 30, 2025.

5. Enrollment for the entrance grades must be completed before July 31, 2025.

6. The high school graduation exam for 2025 is expected to take place on June 26 and June 27, 2025.

7. Other national-level exams will be organized according to the regulations and guidance of the Ministry of Education and Training.

The contractual teachers are entitled to days off on the following public holidays:

- Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

- Lunar New Year Holidays: 05 days;

- Victory Day: 01 day (the 30th of April of the Gregorian calendar);

- International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

- National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

- Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

Thus, the Gregorian New Year is one of the holidays during the year that contractual teachers and teachers will have 1 day off.

When are contractual teachers in Vietnam directly appointed as public employees?

According to the provisions of Article 13 in Decree 115/2020/ND-CP, amended by Clause 7 Article 1 Decree 85/2023/ND-CP, contractual teachers may be directly appointed as public employees when:

- Based on the conditions for applying for public employee recruitment and the requirements of the job position in need, the head of the recruiting authority decides to receive them as public employees for cases that meet the criteria and conditions of the job position. Specifically:

+ Individuals with 05 years or more of work in a professional field corresponding to the position in need at legally recognized organizations, institutions, or units.

The working period defined in this point is the time spent on professional tasks matching the defined job, with mandatory social insurance contributions, excluding probationary time as defined in Article 21 of this Decree.

If the probationary period for the current job as per legal guidelines is shorter than the probationary period of the job being assigned specified in Clause 2 Article 21 of this Decree, this shorter period is included in the probationary period.

In cases of non-continuous work tenure without having received a lump-sum social insurance payout, the time is cumulative.

- Commune-level officials performing work appropriate to the job anticipated for intake.

- Individuals who formerly were officials and public employees, were subsequently reassigned under written orders to other agencies, institutions, or units, while continuing work matching the prospective job position.

- Individuals with a doctorate (recognized by competent authorities) working in or for agencies, institutions abroad or in foreign organizations with bases in Vietnam, aligned with the disciplines required and with 03 years of relevant professional practice.

- Persons with notable talents, unique skills suitable for the job in fields of culture, arts, sport, and traditional craftsmanship following Ministry sector-specific regulations.

- Candidates educated under government scholarship policies, returning to their locality post-graduation.

Recruiting competent authorities or those with delegated recruitment authority may set higher standards for the stated intake cases based on their specific organizational needs.

Additionally, in 2024, contractual teachers who desire to be considered for public employment must meet the following 3 requirements:

[1] Be a contractual teacher currently teaching at public educational institutions;

[2] Have signed employment contracts with mandatory social insurance for teaching at public education institutions within the locality before December 31, 2015;

[4] Have no less than 05 years of service in a position requiring a university degree upwards compatible with the job requirements;

[5] Contractual teachers must fulfill the conditions to apply for public employment.
