Are students in Vietnam entitled to a day off during Christmas in 2024?
Pursuant to the regulations in Article 112 of the Labor Code 2019, the provisions on holidays are as follows:
Holidays
- Employees are entitled to leave work with full pay on the following holidays:
a) New Year's Day: 1 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the Gregorian calendar);
d) International Labor Day: 1 day (May 1 of the Gregorian calendar);
dd) National Independence Day: 2 days (September 2 of the Gregorian calendar and 1 adjacent day);
e) Hùng Vương Commemoration Day: 1 day (March 10 of the lunar calendar).
- Foreign employees working in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are also entitled to 1 traditional new year festival day and one national day of their country.
- Annually, based on practical conditions, the Prime Minister of Vietnam shall decide specifically on the holidays prescribed in Points b and dd Clause 1 of this Article.
According to Article 1 of Decision 2045/QD-BGDDT 2024:
Issuing a Framework for the 2024 - 2025 School Year for Preschool Education, General Education, and Continuing Education Applicable Nationwide as follows:
- The earliest school start date is one week before the school opening ceremony. Particularly for Grade 1, the earliest start date is two weeks before the school opening ceremony.
- The school opening ceremony is on September 5, 2024.
- The first semester ends before January 18, 2025, and the program and school year end before May 31, 2025.
- Certification of completion of the primary school program and recognition of junior high school graduation shall be completed before June 30, 2025.
- Completion of enrollment for initial classes before July 31, 2025.
- The high school graduation exam of 2025 is expected to take place on June 26 and June 27, 2025.
- Other national exams are organized according to the regulations and guidelines of the Ministry of Education and Training.
Therefore, based on the above regulations, students will not have a holiday for Christmas in 2024 and will have to attend school as on a regular day.
Will teachers in Vietnam receive double salary when working on Christmas in 2024?
According to Article 98 of the Labor Code 2019, overtime pay and night work pay are stipulated as follows:
Overtime Pay, Night Work Pay
- Employees working overtime are paid at a rate at least:
a) Ordinary day: 150%;
b) Weekly rest day: 200%;
c) Holidays, Tet, or days with paid leave: 300%, not including salary on these days for employees paid by day.
- Employees working at night are paid an additional at least 30% of the salary calculated according to the ordinary day's wage unit price or salary actually paid for the work.
- Employees working overtime at night, in addition to being paid according to Clauses 1 and 2 of this Article, are also paid an additional 20% of the salary calculated according to the ordinary day percentage or the salary for working during the day on a normal workday, a weekly rest day or a holiday.
