Seniority Allowance Rate

1. Educators involved in teaching and education work with compulsory social insurance contributions for 5 years (60 months) are entitled to a seniority allowance equal to 5% of the current salary plus position allowances and over-frame seniority allowances (if any). From the sixth year onwards, each additional year (12 months) is counted with an additional 1%.

2. The seniority allowance is calculated and paid together with the monthly salary and is used to calculate contributions and benefits for social insurance, health insurance, and unemployment insurance.

What are the periods considered for and not considered for seniority allowance calculation in Vietnam?

According to the provisions of Article 3 of Decree 77/2021/ND-CP, the periods considered for and not considered for seniority allowance calculation for educators are as follows:

- Periods considered for seniority allowance calculation

The periods considered for seniority allowance calculation are determined by the total of the following durations:

+ Duration of teaching and education work with compulsory social insurance contributions in public educational institutions.

+ Duration of teaching and education work with compulsory social insurance contributions in non-public educational institutions (for educators currently teaching in public educational institutions who previously taught in non-public educational institutions).

+ Working duration considered for seniority allowance, including: working duration ranked by salary grades or titles in customs, courts, prosecutions, auditing, inspection, civil judgment enforcement, forestry, national reserves, party inspection; working duration considered for seniority allowance in the army, police, cryptography and in other sectors or professions (if any).

+ Duration of military service according to the law before which the person was counted for professional seniority allowance.

- Periods not considered for seniority allowance calculation

+ Probation period.

+ Leave period without salary for continuous 1 month or more.

+ Period of sick leave, maternity leave exceeding the limits prescribed by the law on social insurance.

+ Duration of working as experts, studying, internships, business trips, surveys domestically and abroad exceeding the time determined by the competent authority.

+ Duration of temporary suspension from work or temporary detention for investigation, prosecution, and trial purposes.

+ Duration not working other than specified in points a, b, c, d, dd Clause 2 Article 3 of Decree 77/2021/ND-CP.

Who is eligible for the seniority allowance for educators in Vietnam?

According to Article 2 of Decree 77/2021/ND-CP, the subjects eligible for the seniority allowance for educators are those currently teaching and educating in public educational institutions and academies, schools, centers tasked with training and retraining under state agencies, political organizations, socio-political organizations (hereinafter collectively referred to as public educational institutions), including:

- Educators include public employees specialized in education and training (code starting with V.07) and public employees specialized in vocational education (code starting with V.09) in the payroll list approved by the competent authority, who are teaching and educating in public educational institutions funded by the state (including funding from the state budget and revenues from self-financed activities as prescribed by law) (1).

- Educators on the payroll list approved by the competent authority, who are teaching, guiding practices, and experiments on training ships, workshop schools, stations, farms, practice centers, laboratories, subject rooms of public general education institutions, continuous education institutions, vocational education institutions, public higher education institutions (1).

Note: Subjects not belonging to (1) and (2) who hold codes starting with V.07 and V.09 are not eligible for the seniority allowance for educators.
