How far is the distance from home to school for boarding primary school students in Vietnam to be eligible for support policies?

Based on Clause 1, Article 4 of Decree 116/2016/ND-CP, the conditions for students to be eligible for support policies in Vietnam are stipulated as follows:

Conditions for students to be eligible for support policies

  1. For primary and lower secondary school students, one of the following conditions must be met:

a) Being a boarding student studying at ethnic minority boarding schools;

b) Being a student where both the student and their parents or guardians have permanent residence in extremely difficult communes and villages and are studying at primary or lower secondary schools in area III communes, extremely difficult villages in ethnic minority and mountainous regions, or extremely difficult coastal and island communes.

The distance from home to school must be 4 km or more for primary students and 7 km or more for lower secondary school students, or the terrain and traffic must be difficult: crossing rivers or streams without bridges; crossing high passes or mountains; crossing landslide-prone areas;

c) Being a student where both the student and their parents or guardians have permanent residence in area III communes, extremely difficult villages in ethnic minority and mountainous regions, and are studying at primary or lower secondary schools in area II communes of ethnic minority and mountainous regions. The home is far from the school or has difficult terrain and traffic as specified in Point b, Clause 1 of this Article.

  1. For upper secondary school students who are ethnic minorities, the following conditions must be met:

a) Studying at an upper secondary school or upper secondary school section of a multi-level school;

b) Both the student and their parents or guardians have permanent residence in area III communes, extremely difficult villages in ethnic minority and mountainous regions, or extremely difficult coastal and island communes.

The distance from home to school must be 10 km or more, or the terrain and traffic must be difficult: crossing rivers or streams without bridges; crossing high passes or mountains; crossing landslide-prone areas.

  1. For upper secondary school students who are Kinh people, in addition to the conditions specified in Clause 2 of this Article, they must be members of families classified as poor households.

Thus, primary school students only need to meet the condition of being boarding students studying at ethnic minority boarding schools to be eligible for support policies.

The condition of a 4 km distance applies only to students where both the student and their parents or guardians have permanent residence in extremely difficult communes and villages, and are studying at primary schools in area III communes or extremely difficult villages in ethnic minority and mountainous regions, or extremely difficult coastal and island communes.

Do ethnic minority primary students in Vietnam need to submit a Residence Information Confirmation to receive support policies?

Based on Point b, Clause 3, Article 6 of Decree 116/2016/ND-CP (amended by Clause 2, Article 3 of Decree 104/2022/ND-CP):

Documents required for applying for support policies

  1. For primary and lower secondary school students studying at schools in extremely difficult communes and villages, the documents include:

a) Support application (for primary students according to Form No. 01, lower secondary school students according to Form No. 02 in the appendix attached to this Decree).

b) Submit a copy of one of the following documents: Citizen ID card, ID card, Residence Information Confirmation, Personal Identification Number and Citizen Information Notification in the National Population Database if the agency or organization cannot access the citizen's residency information in the National Population Database.

  1. For upper secondary school students who are ethnic minorities, the documents include:

a) Support application (Form No. 02 in the appendix attached to this Decree);

b) Submit a copy of one of the following documents: Citizen ID card, ID card, Residence Information Confirmation, Personal Identification Number and Citizen Information Notification in the National Population Database if the agency or organization cannot access the citizen's residency information in the National Population Database.

  1. For upper secondary school students who are Kinh people, the documents include:

a) Support application (Form No. 02 in the appendix attached to this Decree);

Thus, for primary students, the regulation is to submit a copy of one of the following documents: Citizen ID card, ID card, Residence Information Confirmation, Personal Identification Number and Citizen Information Notification in the National Population Database. This means that it is not mandatory to have Residence Information Confirmation, and it can be replaced by other listed documents.

Is it necessary to send the procedure for approving support policies to the Departments of Education in Vietnam?

Based on Point c, Clause 1, Article 7 of Decree 116/2016/ND-CP:

Procedure for approving support policies

  1. Procedure and time of implementation

a) At the time when new students enroll, the schools with students eligible for support according to this Decree will organize, announce widely, and guide the parents (or legal guardians) and the students who are eligible to prepare documents as stipulated in Clause 1, Clause 2, or Clause 3 of Article 6 of this Decree;

b) Within 10 working days from the date of posting the announcement, the family or student must submit the documents to the school. Each eligible person submits one set of documents for the first time when applying for approval within the same school, except for cases of poor households, additional documents proving the poor household status must be submitted for each academic year;

c) Within 5 working days from the deadline for submitting documents, the school is responsible for reviewing and compiling the documents as stipulated in Clause 4 or Clause 5 of Article 6 of this Decree, and sending them to the District Education and Training Office for primary and lower secondary schools; submitting them to the Department of Education and Training for upper secondary schools.

  1. Procedure, authority for decision-making on support policies

a) Within 5 working days from the date of receipt of the support application from the schools, the District Education and Training Office compiles and submits to the District People's Committee for approval; the Department of Education and Training compiles and submits to the Provincial People's Committee for approval;

b) Within 3 working days from the date of receipt of the submission from the District Education and Training Office or the Department of Education and Training, the District or Provincial People's Committee considers and issues the approval decision;

c) The District Education and Training Office, the Department of Education and Training sends the approved results to the schools to announce publicly and organize the implementation.

Thus, for the procedures for approval of support policies, depending on the educational level, the documents must be sent to the District Education and Training Office for primary and lower secondary schools, and to the Department of Education and Training for upper secondary schools as stipulated.
