Are lower secondary school students in Vietnam entitled to a day off for the Mid-Autumn Festival?

Currently, there is no specific regulation on whether students in general or lower secondary school students, in particular, have a holiday on the Mid-Autumn Festival.

Additionally, based on Article 112 of the Labor Code 2019:

Holidays and Tet

1. Employees are entitled to leave with full pay on the following holidays:

a) New Year's Day: 01 day (January 01 Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 Gregorian calendar);

d) International Labor Day: 01 day (May 01 Gregorian calendar);

e) National Day: 02 days (September 02 Gregorian calendar and 01 adjacent day either before or after);

f) Hung Kings' Anniversary: 01 day (March 10 lunar calendar).

2. Foreign employees in Vietnam are entitled to an additional 01 traditional New Year holiday and 01 national day of their country, besides the holidays stated in clause 1 of this Article.

3. Annually, based on actual conditions, the Prime Minister decides the specific holidays as stipulated in point b and point e of clause 1 of this Article.

Employees are entitled to leave with full pay on the following holidays:

- New Year's Day: 01 day (January 01 Gregorian calendar);

- Lunar New Year: 05 days;

- Victory Day: 01 day (April 30 Gregorian calendar);

- International Labor Day: 01 day (May 01 Gregorian calendar);

- National Day: 02 days (September 02 Gregorian calendar and 01 adjacent day either before or after);

- Hung Kings' Anniversary: 01 day (March 10 lunar calendar).

Therefore, Mid-Autumn Festival is not one of the holidays where employees are entitled to leave.

Students typically follow the teacher's calendar; based on the aforementioned regulations, teachers are not entitled to leave on the Mid-Autumn Festival in 2024.

Thus, lower secondary school students will not have a holiday on the Mid-Autumn Festival.

However, lower secondary school students can participate in activities in the evening after school or take part directly in activities organized at school.

What are rights of lower secondary school students in Vietnam?

For lower secondary school and upper secondary school students

The rights of lower secondary school and upper secondary school students are specifically stipulated in Article 35 of the regulations promulgated together with Circular 32/2020/TT-BGDDT:

- To be treated equally in enjoying comprehensive education, to be ensured conditions regarding time, physical facilities, hygiene, and safety for studying in class and self-study at home, to be provided with information about their study and conduct, to use devices and means serving learning, cultural, and sports activities of the school as per regulations.

- To be respected and protected, to be treated fairly and democratically, to have the right to complain to the school and higher education management agencies regarding decisions about themselves; to have the right to transfer schools for legitimate reasons as per current regulations; to study ahead, skip grades, study at an older age as prescribed in Article 33 of the regulations promulgated together with Circular 32/2020/TT-BGDDT.

- To participate in activities aimed at developing talents in subjects, sports, and arts organized by the school if qualified.

- To receive scholarships or other supports as per the regulations for students who receive social policies, those facing life difficulties, and those with special abilities.

- To transfer schools if meeting the requirements; the transfer procedures are carried out per the current regulations of the Minister of Education and Training.

- To enjoy other rights as prescribed by law.
