Under Article 46 of the Road Traffic Order and Safety Law 2024 (effective from January 1, 2025), the regulation on road traffic order and safety assurance for motor vehicles transporting kindergarten children and students in Vietnam is as follows:

1. Motor vehicles engaging in the service for transporting preschool children and students must meet requirements below:
a) Such vehicles must meet requirements under Clause 1 and Clause 2 Article 35 hereof; must be equipped with image capturing devices for preschool children and students and equipment for preventing child abandonment; must have a maximum of 20 years in service life; and must be painted in accordance with regulations of the Government;
b) Such vehicles must be equipped with seat belts or seats appropriate to age groups as per the law.
2. Where motor vehicles engaging in both services of general transportation and transporting of preschool children and students, such vehicles must meet requirements under Clause 3 Article 10, Clause 1 and Clause 2 Article 35 hereof; must be equipped with image capturing devices for preschool children and students and equipment for preventing child abandonment in accordance with Point a Clause 1 of this Article.
3. At least 1 attendant must be assigned on each motor vehicle for the purpose of transporting preschool children and primary school students in order to provide guidance, supervise, maintain order and safety throughout the trips. Where motor vehicles have at least 29 seats (excluding the drivers’ seats) and transport at least 27 preschool children and primary school students, at least 2 attendants will be required per vehicle. Attendants and drivers are responsible for checking for preschool children and primary school students at drop-off; must not leave preschool children and primary school students onboard when both attendants and drivers have left the vehicles.

In Vietnam, what is the maximum number of kindergarten children in a class?
Under Point b, Clause 1, Article 14 of Circular 49/2021/TT-BGDDT regulating the organization of daycare groups and kindergarten classes in Vietnam:
For kindergarten classes: Children from 03 years to 06 years old shall be placed in kindergarten classes. The maximum number of children in a kindergarten class:
+ Kindergarten class from 3 to 4 years old: 25 children;
+ Kindergarten class from 4 to 5 years old: 30 children;
+ Kindergarten class from 5 to 6 years old: 35 children.
- If the number of children in a category of kindergarten class is less than a half of the maximum number mentioned above, then mix categories of kindergarten class provided up to 30 children in a mixed-category kindergarten class or up to 22 children in a mixed-category nursery class.
- Each kindergarten class has no more than 01 child with disabilities who receives mainstream education.
Note: The total number of children in an independent kindergarten class is not to exceed 70 children.
What are the minimum facility standards required for a kindergarten class in Vietnam?
Under Article 18 of Circular 49/2021/TT-BGDDT regulating the minimum facility standards:
+ Rooms for children’s care and education (hereinafter referred to as childcare rooms): Each group or class may exclusively use a room; at least 1,5m2 per child but not smaller than 24m2;
+ Restrooms: Each group or class may exclusively use a restroom; at least 0,4m2 per child; sanitary ware and appliances shall be installed in a manner easily accessible to children. In case a shared restroom must be linked to the childcare room by a corridor, it must be convenient for use and easy to observe;
+ The area of indoor playground must be at least 0,5m2 per child or that of outdoor playground must be at least 1,0m2 per child;
+ Places where children's meals are provided or kitchens must be at least 0.3 m2 per child but not less than 10m2; and they must be independent or installed a door separated from the childcare rooms;
+ There are separate restrooms for teachers and staff;
+ Window bars, stair railings and electrical equipment to ensure safety;
+ There is enough drinking water and tap water for children for use on daily basis, the quality of water sources must meet the prescribed standards.
