Under Article 3 of Circular 29/2024/TT-BGDDT (effective from February 14, 2025), the rules of extra classes are as follows:
- Extra classes are only organized when students wish to attend extra classes and have consent from parents or guardians (hereinafter collectively referred to as parents). Schools, organizations, or individuals organizing extra classes are not allowed to force students into extra classes in any manner.
- The content of extra classes must not contravene the regulations of Vietnamese law, and must not bear biases regarding race, religion, occupation, gender, or social position. There shall be no omission of educational content according to the school's educational plan to include in extra class sessions.
- The purpose of extra classes must contribute to the development of students' qualities and abilities; it must not affect the organization of the school’s education program or the implementation of the subject curriculum by teachers.
- The duration, time, location, and form of organizing extra class sessions must be suitable to the psychological and physical condition of the age group, ensuring students' health; must comply with the legal regulations about working hours, overtime, and other relevant legal regulations concerning security, order, safety, environmental hygiene, and fire prevention in the area where extra classes are held.

What are the cases in which extra classes are not allowed in Vietnam?
Under Article 4 of Circular 17/2012/TT-BGDDT, the cases in which extra classes are not allowed in Vietnam are as follows:
- Extra classes shall not be provided for students who have attended curricular classes for 2 sessions per day.
- Extra classes shall not be provided for primary school students, except for extra-curricular activities: arts, sports, or life skills.
- Higher education institutions, colleges, junior colleges and vocational schools are banned from holding extra classes with compulsory education contents.
- A teacher receiving salaries from wage-fund of public service agencies is banned from:
+ Holding external extra classes unless he/she conducts external extra classes;
+ Conducting external extra classes for students who are in his/her curricular classes without the permit of the Head of his/her superior agency.
What are the regulations on holding internal extra classes in Vietnam?
Under Article 5 of Circular 17/2012/TT-BGDDT regarding holding internal extra classes:
- Each student who wishes to take an extra class shall submit an application for taking extra classes to the institution; his/her parents or guardian (hereinafter referred to as parents) shall append their signatures and write a commitment, and adhere to such commitment.
- The principal of the institution shall receive the application from the student, categorize him/her to an appropriate group of students by his/her learning capacity, assign teachers and hold extra classes according to each group of students.
- Each teacher intending to conduct extra classes shall submit a registration of conducting extra classes which commit to fulfill all duties of a teacher as specified in general regulations and other duties assigned by the institution and seriously comply with regulations on extra classes in the institution.
- The principal shall consider approving the list of teachers, assign teachers and establish timetables for extra classes appropriate to the students’ learning capacity.
In addition, from February 14, 2025, when Circular 29/2024/TT-BGDDT becomes effective, internal and external extra classes and fees will be as follows:
* Internal extra classes (Article 5 of Circular 29/2024/TT-BGDDT)
- Internal extra classes do not incur fees from students and shall only be available to students registering for extra class in each subject as follows:
+ Students whose academic results in the immediate prior semester are not satisfactory;
+ Students selected by the school for nurturing talented students;
+ Final-year students voluntarily registering for entrance exam review, and graduation review according to the school's educational plan.
- The school organizes for the students, who fall within the category specified in clause 1 of this Article, to fill out registration forms for supplementary study according to each subject in each grade level (using Form No. 01 in the Appendix attached to Circular 29/2024/TT-BGDDT).
- Based on the number of registered students, schools shall develop plans for organizing extra classes in specific subjects for each grade.
- The arrangement of classes, schedules, and the organization of extra classes shall ensure the following requirements:
+ Extra classes should be organized by subject for each grade; each class shall have no more than 45 (forty-five) students;
+ Extra class schedules shall not interpose regular schedules and shall not precede the contents scheduled in the school’s educational plan;
+ Each subject is permitted a maximum of 02 (two) extra lessons per week.
- Plans for organizing extra classes shall be publicly available on the school’s website or posted at the school.
* External extra classes (Article 6 of Circular 29/2024/TT-BGDDT)
- Organizations or individuals providing external extra classes with fees for students (hereinafter referred to as extra class centers) must fulfill the following requirements:
+ Register the business in accordance with the law;
+ Publicly disclose on electronic portals or post at the location of the extra class center regarding the subjects for which extra class is organized; the duration of extra class for each subject according to each grade; the location, form, and schedule of extra class sessions; the list of teachers of extra classes and the fees for extra class before enrolling students in extra classes (according to Form No. 02 in the Appendix attached to this Circular).
- External extra classes must ensure good moral character and possess the professional capacity suitable for the subject they are extra class.
- Teachers teaching at schools who wish to provide external extra classes must report to the Principal or Director or head of the school (hereinafter referred to as the Principal) regarding the subject, location, form, and schedule of their extra classes (according to Form No. 03 in the Appendix attached to this Circular).
* Collection and Management of Fees (Article 7 of Circular 29/2024/TT-BGDDT)
- The funding for organizing internal extra classes shall be covered by the state budget and other lawful sources as prescribed by law.
- The fees for external extra classes shall follow the agreement between students' parents, students, and the extra class center.
- The collection, management, and utilization of fees for extra classes shall comply with legal regulations on finance, state budget, assets, accounting, taxation, and other related provisions.
