What are the disciplinary actions against lower secondary school students engaged in the illegal trade of fireworks in Vietnam?
In Official Dispatch 8258/BGDDT-GDCTHSSV of 2024, the Ministry of Education and Training requires the departments of education and training; parent universities, academies, universities, and pedagogical schools to thoroughly implement the following content:
1. Regarding security order, crime prevention, and fire prevention
a) Enhance the propaganda and education for students to adopt a civilized lifestyle, maintain social order, improve skills on accident and injury prevention, avoid social vices, ensure security order, and school safety. Raise awareness and responsibility for self-prevention against the methods and approaches of various types of crime, especially crimes operating in cyberspace, black credit crimes, asset misappropriation crimes, social vices, gambling, football betting, commercial fraud, public disturbance, and resistance against law enforcement officers during the Lunar New Year.
b) Ensure shifts and protect agencies, guarantee absolute safety of physical facilities, prevent and combat fire and explosion during the New Year holiday; carry out propaganda and education for students, strictly prohibit students from participating in the production, purchase, sale, transportation, storage, and illegal use of weapons, explosives, support tools, and explosive fireworks. Comply with regulations and conditions to ensure fire and explosion prevention. Have solutions to guarantee the 2024 - 2025 academic year plan after the Lunar New Year holiday.

According to Clause 2, Article 38 of the lower secondary school, upper secondary school and multi-level school charter promulgated with Circular 32/2020/TT-BGDDT, the reward and discipline for students are regulated as follows:
Reward and discipline
1. Teachers, secondary schools and education authorities shall reward students with learning and training achievements in the following ways:
a) Commend them in front of the class or the whole school.
b) Grant them titles for students according to regulations.
c) Grant certificates and certificates of merit to students with outstanding achievements or exceptional improvement in learning or emulation movements and competition winners according to regulations and with permission from the Ministry of Education and Training.
d) Other ways to reward.
2. Students making a mistake during the learning and training process shall be corrected or disciplined in the following ways:
a) Give the student a reminder, directly support them in correcting their mistake.
b) Reprimand the student, inform the student’s parent(s) to have the parent(s) cooperate in supporting the student in correcting their mistake.
c) Suspend the student’s study at school for a definite period and take other correcting measures according to regulations from the Ministry of Education and Training.
During the Lunar New Year 2025, the Ministry of Education and Training strictly prohibits students from participating in the production, purchase, sale, transportation, storage, and illegal use of weapons, explosives, support tools, and explosive fireworks.
Lower secondary school students engaged in the illegal trade of fireworks may face disciplinary actions including:
- Give the student a reminder, directly support them in correcting their mistake.

Can homeroom teachers attend meetings of the student disciplinary council in Vietnam?
Under Point b, Clause 2, Article 29 of the lower secondary school, upper secondary school and multi-level school charter issued with Circular 32/2020/TT-BGDDT:
Rights of teachers and staff
1. Rights of teachers and staff:
a) Independently perform their assigned duties with support from specialized teams and the school.
b) Enjoy salary, allowances and incentive policies (if any) as per the law; change their professional title; and enjoy material and spiritual rights as prescribed by law.
c) Be enabled to learn and train to improve their political qualifications and professional qualifications and knowledge; receive full salary, allowances calculated based on salary and other benefits as per the law when sent to study by the competent authority.
d) Enter into visiting teaching agreements and scientific research agreements with other schools and educational institutions or scientific research institutions provided that they complete the duties towards their workplace and receive written permission from the principal.
dd) Receive respect and protection with regard to their honor, dignity and body integrity.
e) Have summer vacation and other leaves as prescribed by law.
g) Hold other rights as per the law.
2. Rights of homeroom teachers besides those provided for in Clause 1 herein:
a) Join other classes and educational activities involving their charges.
b) Attend meetings of the reward council and disciplinary council upon handling of matters concerning their charges.
c) Participate in refresher courses and symposia about homeroom teacher duties.
d) Permit a student to take a maximum of 03 consecutive days off if they have a legitimate reason for absence.
dd) Have their teaching hour norm reduced according to regulations.
Thus, homeroom teachers are allowed to attend meetings of the reward council and disciplinary council upon handling of matters concerning their charges.
