Under Article 2 of Decree 77/2021/ND-CP on entities eligible for the seniority allowance in Vietnam:

Eligible Entities

This Decree applies to teachers who are currently teaching and educating in public educational institutions and academies, schools, centers tasked with training and fostering under state agencies, political organizations, socio-political organizations (hereinafter collectively referred to as public educational institutions) and have been charged and graded salaries according to Decree No. 204/2004/ND-CP dated December 14, 2004, by the Government of Vietnam regarding salary policies for officials, public employees, and armed forces, including:

1. Teachers include public employees specializing in education and training (code starting with V.07) and public employees specializing in vocational education (code starting with V.09) in the salary list approved by the competent authority, who are currently teaching and educating in public educational institutions funded by the State (including revenues from the state budget and operating income in accordance with legal provisions).

2.Teachers listed in the salary payment, approved by the competent authority, who are currently teaching, guiding practice, experiments at training ships, school workshops, stations, camps, practice centers, laboratories, subject rooms of regular education institutions, continuing education institutions, vocational education institutions, public higher education institutions.

3. Individuals not outlined in Clauses 1 and 2 of this Article holding a code beginning with V.07 or V.09 are not eligible for the teachers' seniority allowance.

Therefore, teachers who hold the professional title codes and do not teach in Vietnam receive seniority allowances are not entitled to seniority allowance.

Seniority allowance is only applicable to teachers currently teaching and educating in public educational institutions and academies, schools, and centers tasked with training and fostering under state agencies, political organizations, and socio-political organizations.

What is the period covered by seniority allowance for teachers in Vietnam?

According to Clause 1, Article 3 of Decree 77/2021/ND-CP, the period covered by seniority allowance for teachers in Vietnam is determined by the total of the following periods:

- The period of teaching and educating with mandatory social insurance contributions in public educational institutions.

- The period of teaching and educating with mandatory social insurance contributions in non-public educational institutions (for teachers currently teaching and educating in public educational institutions who had previously taught and educated in non-public educational institutions).

- The working period covered by seniority allowance, including working periods salaried according to one of the customs, courts, procuracies, audit, inspection, civil judgment enforcement, forest protection, national reserve, CPV inspection industries, periods covered by seniority allowance in the army, police, ciphering, and periods covered by seniority in other industries or professions (if applicable).

- The period of military service as prescribed by law, during which one was receiving seniority allowance in their occupation before entering military service.

What are the funding sources for paying seniority allowances to teachers in Vietnam?

According to Article 5 of Decree 77/2021/ND-CP, the funding for paying seniority allowances to teachers in Vietnam is funded from the unit's legitimate revenues and the state budget:

- For public educational institutions that self-cover regular and investment expenditures and those that self-cover regular expenditures: The funding for paying seniority allowances to teachers is funded from the unit's operating revenues.

- For public educational institutions covering their expenditures partially: The funding for paying seniority allowances to teachers is funded from the unit's operating revenues and the state budget allocation according to the current state budget management decentralization.

- For public educational institutions where the State guarantees recurrent expenditures: The funding for paying seniority allowances to teachers is funded by the state budget and allocated in the institution's annual budget estimates under the current state budget management decentralization.

Note: In cases where the State adjusts the statutory pay rate, ministries, central authorities, and provinces shall organize, guide, review, and consolidate reports on the demand, funding sources for paying seniority allowances to teachers into the demand for salary reform according to current regulations on determining the demand, and funding sources for annual statutory pay rate adjustments; submitted to the Ministry of Finance for consideration and appraisal according to regulations.
