Based on Article 2 of the Organization and Operational Regulations of the Continuing Education Center issued by the Ministry of Education and Training attached to Circular 10/2021/TT-BGDDT, the legal position of the Center is as follows:
Legal Position of the Center
1. The center is a continuing education institution within the national education system. The center has juridical personality, its own seal, and its own account.
2. The Department of Education and Training directly manages and directs the Center.
Therefore, the Continuing Education Center has juridical personality along with its own seal and account.

What are the duties and powers of the Continuing Education Center in Vietnam?
Based on Article 4 of the Organization and Operational Regulations of the Continuing Education Center issued by the Ministry of Education and Training attached to Circular 10/2021/TT-BGDDT, the duties and powers of the Center are as follows:
- Organize the implementation of educational and training programs:
+ Literacy programs.
+ Continuing education programs at the secondary level for secondary graduation diplomas, continuing education programs at the high school level for high school graduation diplomas for those eligible for social policies, people with disabilities, subjects of school age following the annual local plan, and workers who need to complete secondary education programs.
+ Educational programs meeting learners’ needs, updating knowledge, skills, technology transfer in the following fields: law, culture, society, sports, arts, environment, health, economy, finance; skills education programs;
Technology transfer programs in labor, production contributing to increasing labor productivity.
+ Training, retraining programs to enhance professional knowledge, job skills including: retraining in foreign languages, computer skills, and cultural knowledge; retraining in ethnic minority languages for officials working in ethnic, mountainous areas; regular training for teachers;
Retraining teachers from secondary schools, high schools on integrated technical education, career orientation;
Retraining programs for teachers to meet the demand for enhancing professional knowledge and skills; and other retraining programs to enhance professional knowledge, job skills for officials and public employees according to local plans and lifelong learning needs of the people.
- Connect educational and training activities domestically and internationally in accordance with Education Law 2019 and relevant laws. Organize learning, practicing, and experiencing activities for learners through cooperation and linking educational, training programs.
- Exercise autonomy according to the law and some specific provisions as follows:
+ Decide on the Center's goals, mission, strategy, and development plan;
+ Decide on the establishment of the organizational structure, develop the team of teachers, and management staff based on the Center's development strategy and planning; define the functions and tasks of the Center's organizations;
+ Manage financial income and expenses, invest in developing conditions ensuring training quality as per the law; decide on tuition fees for educational programs meeting learners' needs in accordance with financial autonomy regulations for the Center;
+ Recruit and manage learners; develop educational programs; organize the compilation or selection of teaching materials tailored to each educational program's goals; manage and issue certificates to learners according to the law;
+ Implement scientific and technological research activities, international cooperation according to the Center's development strategy and plan; ensure the Center's educational quality; select the educational quality accreditation organization to register for accreditation.
- Mobilize, manage, and utilize resources according to the law.
- Build, invest in educational facilities, equipment as required by educational programs.
- Recruit, utilize, manage educators, management staff, and public employees; organize for educators to update and enhance professional skills; organize for educators, public employees, and learners to participate in social activities.
- Implement democratic regulations within the Center.
- Implement policies, provide information, report, and be accountable to competent authorities, learners, and society.
- Perform other duties and powers as provided by law.

According to Article 5 of the Organization and Operational Regulations of the Continuing Education Center issued by the Ministry of Education and Training attached to Circular 10/2021/TT-BGDDT, the organizational structure of the Continuing Education Center is as follows:
- Director, Deputy Directors of the Center.
- Functional departments, professional departments, and service units.
- Classrooms.
- Production, business, and service units serving educational and training activities (if any).
- Commendation and Discipline Council.
- Advisory Council (when necessary).
