Pursuant to Article 35 of the Primary School Charter, issued together with Circular 28/2020/TT-BGDDT, the rights of primary school students, including grade 1 students, are as follows:

- To be educated, to study for comprehensive development, and to maximize personal potential; to study in a school or class implementing the primary education program that is convenient for commuting in their residential area.

- To choose a school or transfer to another school outside the residential area if the school can accommodate them.

- Primary-age students returning from abroad, children of foreigners studying or working in Vietnam, and children who have not attended school due to difficult circumstances and wish to study in a primary school shall be assessed by the principal for appropriate class placement.

- Disabled students shall be included in a primary school; provided with conditions to study and train; and assessed according to their individual education plan.

- Students may shorten the time to complete the program, study at an age older than the regulated age, extend the study time, or repeat a grade.

- Students with good health and early intellectual development can skip grades within their education level.

The procedure is conducted as follows:

Parents or guardians of the student submit a request to the school.

The school principal establishes a survey and consultation council, including: the principal or vice-principal and the school's Parent Committee; the current teacher, the upper-grade teacher, the medical staff, and the team counselor.

Based on the survey results, the principal completes the dossier and reports to the Head of the Education and Training Department for consideration and decision.

- Students with limited academic performance who have been directly guided and assisted by teachers, parents, or guardians but still have not completed, depending on the level of uncompleted tasks, teachers report to the principal for consideration of promoting or repeating a grade, and jointly decide with the family on appropriate educational measures.

(2) The right to be protected, cared for, respected, and treated equally and democratically; to ensure legitimate rights and interests; to be fully informed about their study and training process; to ensure conditions of time, facilities, hygiene, and safety for studying and training.

(3) The right to participate in activities that promote individual abilities; to express personal opinions and wishes.

(4) The right to receive scholarships and social policies as prescribed.

(5) The right to enjoy other rights as prescribed by law.
