Under Article 7 of Decree 168/2024/ND-CP:

Penalties and point deductions from the driving license of operators of motorbikes, mopeds, vehicles similar to motorbikes, and vehicles similar to mopeds commiting violations against the road traffic regulations

2. A fine ranging from 400,000 to 600,000 VND to the operator engaging in any of the following violations:

a) Stopping or parking on the roadway outside urban areas where there is a shoulder;

d) Stopping or parking on the road causing traffic obstruction; gathering of 03 or more vehicles on the roadbed or in tunnels; parking or placing vehicles on the roadbed or sidewalks illegally;

e) Stopping or parking at passenger pick-up/drop-off points, at intersections, on pedestrian crossings; stopping where signs prohibit stopping and parking; parking where signs prohibit parking or stopping and parking; not complying with the rules of stopping or parking at intersections level with railways; stopping or parking within the railway traffic safety corridor;

10. A fine ranging from 10,000,000 to 14,000,000 VND to the operator engaging in any of the following violations:

a) Operating a vehicle without checking or reducing speed, or stopping to ensure safety as prescribed, causing traffic accidents; operating a vehicle exceeding the speed limit causing traffic accidents; entering highways, stopping, parking, turning, reversing, overtaking, changing direction, changing lanes non compliantly causing traffic accidents; not driving in the correct lane or keeping a safe distance between vehicles as prescribed causing traffic accidents or entering roads with signs prohibiting entry to the type of vehicle being operated, going against a one-way street, driving against the sign prohibiting reverse direction causing traffic accidents;

Therefore, Vietnamese law does not stipulate penalties for stopping a vehicle to wear a raincoat. However, stopping a vehicle must comply with regulations to ensure safety for oneself and others. Stopping to wear a raincoat at an unauthorized location may result in a penalty for the operator.

Any noncompliant motorcycle stopping can result in a fine of up to 14 million VND if such stopping or parking causes a traffic accident.

Which types of motorcycles can students in Vietnam operate?

According to Article 59 of Road Traffic Safety and Order Law 2024:

Age and health requirements of vehicle operators participating in road traffic

1. Age requirements of drivers, operators of heavy-duty vehicles are as follows:

a) People of at least 16 years of age may operate mopeds;

b) People of at least 18 years of age may apply for A1, A, B1, B, C1 driver license and certificate of road traffic law trainings in order to operate heavy-duty vehicles in road traffic;

c) People of at least 21 years of age may apply for C and BE driver license;

d) People of at least 24 years of age may apply for D1, D2, C1E, and CE driver license;

dd) People of at least 27 years of age may apply for D, D1E, D2E, and DE driver license;

e) Operators of passenger motor vehicles (including buses) with a seating capacity of more than 29 people (excluding the driver’s seat), passenger sleeper motor vehicles must not be older than 57 in case of male operators and 55 in case of female operators.

Students aged 16 and over are allowed to operate mopeds (vehicles with a design speed not exceeding 50 km/h; if powered by an internal combustion engine, the working or equivalent capacity does not exceed 50 cm3; if powered by an electric motor, the engine capacity does not exceed 04 kW).

Students aged 18 and over may acquire a driving license and are qualified to operate relevant vehicles based on the license obtained.

What are the regulations on educating regulations of the law pertaining to road traffic order and safety in Vietnam?

According to Article 6 of Road Traffic Safety and Order Law 2024, the regulations on educating regulations of the law pertaining to road traffic order and safety in Vietnam are as follows:

- Educate children in preschools, students of formal education institutions, vocational education and training facilities on regulations of the law pertaining to road traffic order and safety.

- Traffic police forces are responsible for taking charge, cooperating with authorities governing upper-secondary schools, vocational education and training facilities in providing guidelines on safe motorbike operation for the students.

- Ministry of Education and Training and Ministry of Labor - War Invalids and Social Affairs shall, within their tasks and powers, take charge and cooperate with Ministry of Public Security, relevant ministerial agencies in developing, integrating, and incorporating regulations of the law pertaining to road traffic order and safety to education program in preschools, formal education institutions, vocational education and training facilities in a manner appropriate to education levels and majors.
