Does Decree 168 amend the whole of Decree 100?

Under Article 52 of Decree 168/2024/ND-CP on amendments to Decree 100/2019/ND-CP on administrative penalties for road traffic offences and rail transport offences (amended and supplemented by Decree 123/2021/ND-CP):

Amendments to Decree No. 100/2019/ND-CP dated December 30, 2019, of the Government of Vietnam on administrative penalties for road traffic offences and rail transport offencesc as amended and supplemented by certain articles under Decree No. 123/2021/ND-CP dated December 28, 2021, of the Government of Vietnam on amendments to several Articles of Decrees providing for administrative penalties for maritime offences; road traffic offences and rail transport offences; civil aviation offences

1. Add clause 2a following clause 2 of Article 1 as follows:

“2a. Forms, levels of sanctions, remedial measures for each administrative violation; authority to make records, authority to impose sanctions, specific monetary fines according to each title regarding traffic order and safety in the field of road traffic shall comply with provisions at the Decree regulating administrative sanctions on traffic order and safety in the field of road traffic; excluding point deduction, point restoration on driver's licenses.”

2. Amend and supplement certain points of clause 6 of Article 28 as follows:

a) Amend and supplement point d clause 6 of Article 28 as follows:

“d) Failure to implement correctly the registered and publicly posted contents concerning: fare rates; service prices; service quality standards in transportation, transportation support services;”;

b) Amend and supplement point i clause 6 of Article 28 as follows:

“i) Using transport business vehicles that do not meet the quality conditions of the registered form of business;”.

3. Amend and supplement point a, point b clause 10 of Article 28 as follows:

“a) Conducting violations prescribed at point a, point b, point d, point đ, point h, point l, point o, point p, point r, point s, point t clause 4; point d, point i, point k, point l, point n, point q clause 6; point e clause 7 of this Article will result in revocation of signage usage from 01 month to 03 months (if available or granted) for the violating vehicle;

b) Conducting violations prescribed at point i, point k clause 4; point h clause 6; point b clause 7 of this Article will result in revocation of transport business license from 01 month to 03 months;”.

4. Amend and supplement point h clause 11 of Article 28 as follows:

“h) Conducting violations prescribed at point n clause 6 of this Article requires the installation of meters and invoice printing devices on vehicles as conformable;”.

5. Amend and supplement certain points and clauses of Article 74 as follows:

a) Amend and supplement point b clause 2 of Article 74 as follows:

“b) Point a, point b, point d, point đ clause 2; point b, point c, point d, point e clause 3; clause 4; point b clause 5; point a, point b, point c, point d, point h clause 6 Article 12;”;

b) Amend and supplement point e clause 2 of Article 74 as follows:

“e) Point a, point b, point c, point d, point đ, point i clause 2; point a, point b, point c, point d, point đ, point p clause 4; point d, point i, point n, point q clause 6; point a, point b, point c clause 7 Article 28;”;

c) Amend and supplement point g clause 2 of Article 74 as follows:

“g) Article 31;”;

d) Amend and supplement point m clause 5 Article 74 as follows:

“m) Point a, point b, point c, point d, point đ, point i clause 2; point b, point c clause 3; point a, point b, point c, point d, point đ, point h, point i, point k, point l, point m, point n, point o, point p, point r, point s, point t clause 4; point a, point b, point d, point h, point i, point k, point l, point n, point q clause 6; point a, point b, point c, point d, point e, point g, point k clause 7; point c, point d clause 8 Article 28;”;

dd) Amend and supplement point o clause 5 Article 74 as follows:

“o) Article 31;”.

6. Amend and supplement certain points and clauses of Article 80 as follows:

a) Amend and supplement point i clause 3 of Article 80 as follows:

“i) Violations of fare regulations stipulated at Article 23 (point l clause 3), Article 31 (clause 2, clause 3), and corresponding violations stipulated at Article 28 (point d clause 6), in case an individual conducting transport business directly operates the vehicle or serves on the vehicle, shall be sanctioned according to point d clause 6 Article 28 of this Decree;”;

b) Amend and supplement point l clause 3 Article 80 as follows:

“l) Violations of passenger transportation business by contract regulations stipulated at Article 23 (point n clause 5), and corresponding violations stipulated at Article 28 (point p clause 4), in case an individual conducting transport business directly operates the vehicle, shall be sanctioned according to corresponding points, clauses of Article 28 of this Decree;”;

c) Amend and supplement the first paragraph of clause 5 Article 80 as follows:

“5. Regarding violations concerning carrying more passengers than permitted by the vehicle's capacity, violations of the vehicle's load, bridge road regulations stipulated at Article 65 of this Decree, the vehicle operator, owner, transport business unit, transport support service, individual, organization loading goods onto railway transport vehicles must cease the violation according to the following specific rules:”.

7. Amend and supplement clause 4 Article 82 as follows:

“4. When a vehicle is temporarily seized pursuant to clause 2 of this Article, the vehicle owner must cover all costs (if any) for using another substitute vehicle to transport people, goods carried on the seized vehicle.”

Thus, Decree 168 does not amend the whole of Decree 100. It only amends and supplements certain points, clauses, and articles.

According to Article 6 of Law on Road Traffic Order and Safety 2024 on educating regulations of the law pertaining to road traffic order and safety:

Educating regulations of the law pertaining to road traffic order and safety

1. Educate children in preschools, students of formal education institutions, vocational education and training facilities on regulations of the law pertaining to road traffic order and safety.

2. Traffic police forces are responsible for taking charge, cooperating with authorities governing upper-secondary schools, vocational education and training facilities in providing guidelines on safe motorbike operation for the students.

3. Ministry of Education and Training and Ministry of Labor - War Invalids and Social Affairs shall, within their tasks and powers, take charge and cooperate with Ministry of Public Security, relevant ministerial agencies in developing, integrating, and incorporating regulations of the law pertaining to road traffic order and safety to education program in preschools, formal education institutions, vocational education and training facilities in a manner appropriate to education levels and majors.

Thus, preschool children will be educated on regulations of the law pertaining to road traffic order and safety.

What is the content of education on regulations of the law pertaining to road traffic order and safety in educational institutions of Vietnam from January 1, 2025?

Under Article 4 of Decree 151/2024/ND-CP (effective from January 1, 2025) regulating the content of education on regulations of the law pertaining to road traffic order and safety in educational institutions in Vietnam:

(1) The content of legal education on road traffic order and safety for children at preschool education institutions includes:

- Recognizing types of road traffic vehicles;

- Recognizing traffic signal lights, the meaning of traffic signals, and some common road signs;

- Safety when walking or on road traffic vehicles;

- Knowing how to wear a helmet properly;

- Safe play areas;

- The dangers and consequences of not complying with road traffic safety regulations.

(2) The content of legal education on road traffic order and safety for primary school students includes:

- Recognizing the commands of traffic controllers; traffic signal lights; common road signs;

- Some common road traffic rules; recognizing the necessity to comply with road traffic rules;

- Crossing the road safely;

- Selecting and wearing a helmet correctly;

- Safely getting on and off bicycles, motorcycles, and mopeds;- Familiarizing with bicycles and how to ride a bicycle safely;

- Some skills to avoid road traffic accidents.

(3) The content of legal education on road traffic order and safety for lower secondary school students includes:

- Road traffic rules;

- Recognizing and obeying road signs;

- Wearing a standard helmet and strapping it correctly when participating in road traffic;

- Safety when sitting on a motor vehicle;

- How to ride bicycles and electric bicycles safely;

- Preventing risks and consequences of traffic accidents and handling traffic incidents.

(4) The content of legal education on road traffic order and safety for upper secondary school students and students of vocational education and training institutions includes:

- Road traffic rules; road signs; speed and safe distance of motor vehicles;

- Predicting and avoiding hazards;

- How to ride a motorcycle safely.
