Under Article 2 of the Regulation on the organization and operation of pre-university schools issued together with Circular 24/2011/TT-BGDDT, a pre-university school is a specialized type of school. The state establishes pre-university schools for children of ethnic minorities and children of ethnic minority households permanently living in extremely disadvantaged areas to contribute to training staff resources for these areas.

- The establishment scheme clearly defines the objectives, tasks, educational programs, and content; land, infrastructure, equipment, proposed school construction site, organization apparatus, and resources and finance; the strategic direction for the construction and development of the school.

What are the procedures for establishing a pre-university school in Vietnam under the new regulations?
Pursuant to Article 64 of Decree 125/2024/ND-CP stipulating the procedures for establishing a pre-university school in Vietnam as follows:
Procedures for establishing a pre-university school
1. The Minister of Education and Training decides on the establishment of a pre-university school.
2. The application includes:
a) An application form for the establishment of a pre-university school from the competent management authority (According to Form No. 01 Appendix I attached to this Decree);
b) The establishment scheme (According to Form No. 02 Appendix I attached to this Decree);
c) A document of land allocation approval from the provincial People's Committee where the school's headquarters are located (clearly specifying the address, area, and boundary markers of the land).
3. Implementation process:
a) The agency proposing the establishment of the school submits 01 application as prescribed in Clause 2 of this Article through the online public service portal, by post, or directly to the Ministry of Education and Training;
b) Within 05 working days from the date of receipt of the complete application, if the application is invalid, the Ministry of Education and Training will notify in writing the contents to be amended or supplemented to the agency proposing the establishment; if the application is valid, the Ministry of Education and Training organizes the appraisal of the eligibility for establishing the school and prepares an appraisal report to assess compliance with the provisions of Article 63 of this Decree;
c) Within 20 days from the date of the appraisal report, the Minister of Education and Training decides to establish the pre-university school.
The decision to establish a pre-university school (according to Form No. 10 Appendix I attached to this Decree) is publicly announced in the mass media.
Thus, the procedures for establishing a pre-university school in Vietnam under the new regulations are as follows:

When does a pre-university school in Vietnam have its operations suspended?
Pursuant to Clause 1, Article 67 of Decree 125/2024/ND-CP, a pre-university school in Vietnam has its operations suspended in the following cases:
- Committing fraud to be allowed educational activities;
- Being not authorized to allow educational activities;
- Failing to implement educational activities within 1 year from the date of being permitted educational activities;
- Violating legal regulations on education subject to administrative penalties leading to suspension of educational activities;
- Other violations as prescribed by law.
