c) The decision on establishment or permission for establishment of the independent preschool institution has been issued ultra vires;

d) Its educational activities have not been conducted within the duration of 01 year from the date on which the decision on establishment or permission for establishment of the independent preschool institution is issued;

In Vietnam, is it required to report on the establishment of a public independent preschool institution to the President of the district-level People’s Committee?

Pursuant to point a, clause 2, Article 11 of Decree 125/2024/ND-CP:

Article 11. Procedures for establishment of public independent preschool institutions or permission for establishment of non-public or private independent preschool institutions

1. The President of the commune-level People’s Committee shall issue a decision on establishment or permission for establishment of an independent preschool institution.

2. Application:

a) In case of establishment of a public independent preschool institution, the application includes:

A report on establishment of a public independent preschool institution sent to the President of the district-level People’s Committee;

A written request for on-site inspection of fulfillment of requirements for establishment;

b) In case of permission for establishment of a non-public or private independent preschool institution, the application includes:

A written request for permission for establishment of the non-public or private independent preschool institution (according to Form No. 08 Appendix I enclosed with this Decree);

Copies of legal documents proving land use rights and house ownership or agreement on rental of location for the independent preschool institution;

A legal confirmation document on the amount of investment in establishment of the non-public or private independent preschool institution, ensuring legitimacy and conformity with the estimated scale at the time of establishment.

Thus, a report on the establishment of a public independent preschool institution must be sent to the President of the district-level People’s Committee.

What are the requirements of the preschool education program in Vietnam?

Under Article 25 of the Education Law 2019, the specific provisions are as follows:

Programmes of preschool education

1. Programmes of preschool education shall satisfy the following requirements:

a) Reflect the objectives of preschool education;

b) Concretize the outcome requirements of different age groups, educational activities, methods and modes of organizing educational activities, educational environment and evaluation of the development of children;

c) Be consistent throughout the country and implemented flexibly, suitable with specific conditions of localities and institutions of preschool education.

2. The Minister of Education and Training shall establish the National review council for appraising curricula for preschool education to appraise programmes of preschool education. The council shall be composed of teachers, education managers, experienced and prestigious scientists in the field of education and representatives of relevant agencies and organisations. At least one-third of the council members must be teachers who are working in institutions of preschool education. The council and the council members shall be responsible for the appraisal contents and quality.

3. The Minister of Education and Training shall promulgate programmes of preschool education after receiving the appraisals of the National review council for appraising curricula for preschool education; stipulate standards, compiling and editing processes of programmes of preschool education; stipulate standards and selection of toys and learning materials used in institutions of preschool education; stipulate the duties, powers, operating methods, standards, number and structure of members of the National review council for appraising curricula for preschool education.

Thus, according to the above regulations, the preschool education program must meet the following requirements:

- Reflect the objectives of preschool education;

- Concretize the outcome requirements of different age groups, educational activities, methods and modes of organizing educational activities, educational environment and evaluation of the development of children;

- Be consistent throughout the country and implemented flexibly, suitable with specific conditions of localities and institutions of preschool education.
