Are 18-of-age members of the Ho Chi Minh Communist Youth Union eligible for retraining on national defense and security?

Under Clause 2, Article 14 of the Law on National Defense and Security Education 2013:

For individuals in State agencies, political organizations, political-social organizations

1. Retraining on national defense and security for individuals in State agencies, political organizations, and political-social organizations shall be uniformly implemented nationwide.

2. Individuals eligible for retraining on national defense and security include:

a) Managerial officials and public employees;

b) Elected representatives;

c) Managers in state enterprises;

d) part-time officials in communes, wards, towns (hereinafter referred to as communes); village chiefs; leaders of associations in villages;

dd) Members of the Communist Party of Vietnam.

3. The program, content, form, and duration of retraining on national defense and security for the individuals specified in Clause 2 of this Article shall be suitable to the standards of leading and managerial  positions and task requirements.

Therefore, the individuals eligible for retraining on national defense and security currently include: managerial officials and public employees; elected representatives; managers in state enterprises; part-time officials in communes, wards, and towns (hereinafter referred to as communes); village chiefs; leaders of associations in villages; members of the Communist Party of Vietnam.

Thus, 18-of-age members of the Ho Chi Minh Communist Youth Union are eligible for retraining on national defense and security.

Is a private company director who is a foreigner in Vietnam required to participate in retraining on national defense and security?

Under Article 15 of the Law on National Defense and Security Education 2013:

For managers of enterprises outside the State sector, non-public service providers

1. Managers of enterprises outside the State sector who must participate in retraining on national defense and security include:

a) Enterprises of medium scale or larger;

b) Enterprises operating in service of national defense and security;

c) Enterprises operating in remote areas, border regions, islands.

2. Managers of non-public service providers must participate in retraining on national defense and security.

3. The content of retraining on national defense and security for the individuals stipulated in Clause 1 and Clause 2 of this Article focuses on State policies and laws on national defense and security.

4. This regulation does not apply to foreigners.

Therefore, managers of enterprises outside the State sector must participate in retraining on national defense and security, including the aforementioned positions. However, this regulation does not apply to foreigners. Thus, a private company director who is a foreigner is not required to participate in retraining on national defense and security.

What are the general regulations on training national defense and security education teachers and lecturers in Vietnam?

Under Article 24 of the Law on National Defense and Security Education 2013, the general regulations on training national defense and security education teachers and lecturers in Vietnam are as follows:

- Training national defense and security education teachers and lecturers is regulated as follows:

+ Regular training in the national defense and security education specialization, focusing on 4 years for those with a high school diploma;

+ Second-degree training, focusing on 2 years for those who already have a bachelor's degree in another field;

+ Second-degree training, focusing on 18 months for teachers, lecturers teaching at high schools, vocational education and training institutions, and higher education institutions, who already have a certificate of national defense and security education training for no less than 6 months.

- national defense and security education teachers and lecturers are periodically retrained, and trained at schools of the people’s armed forces, national defense, and security education centers.

- The Government of Vietnam stipulates the conditions for higher education institutions and schools of the People’s Armed Forces to train teachers, and lecturers in national defense and security education; the Ministry of Education and Training decides higher education institutions, and schools of the People’s Armed Forces that satisfy the conditions for training teachers, lecturers in this field.

- The Ministry of Education and Training, associated ministries, and provincial People’s Committees direct affiliated educational institutions to build recruitment, and training plans, and recruit teams of national defense and security education teachers and lecturers from high school to university level.
