Are teachers who are on probationary period in Vietnam entitled to preferential teaching allowance?
Based on subsection 1, section 1, Part I of Joint Circular 01/2006/TTLT-BGD&DT-BNV-BTC stipulating the scope, subjects, and conditions of application:
SCOPE, SUBJECTS, AND CONDITIONS OF APPLICATION
- Scope and subjects of application
a) Teachers (including those on probation, contract-based) who are on the salary scale, directly teaching at public educational institutions under the national education system and schools, centers, academies under state agencies, Communist Party, political-social organizations (hereinafter referred to as public educational institutions) funded by the state (including state budget allocations and revenue from career activities as prescribed by law);
b) Teachers (including those on probation, contract-based) who are on the salary scale of public educational institutions performing the duties of team leaders, guiding practice at school workshops, stations, camps, laboratories;
c) Management staff who are on the salary scale of public educational institutions, directly teaching the sufficient number of hours as regulated by the competent authority.
Thus, teachers in the probationary period are not eligible for preferential teaching allowances.

Is it possible to appoint teachers in the probationary period to the public employee professional title in Vietnam?
Based on Article 24 of Decree 115/2020/ND-CP stipulating the appointment to the public employee professional title for probationary individuals after the probationary period:
Appointment to the Public Employee Professional Title for Probationary Individuals After the Probationary Period
- Upon completing the probationary period, the probationary individual must report the probation results in writing, covering the contents specified in clause 3, Article 21 of this Decree; the probationary instructor is responsible for commenting and evaluating the probation results in writing. These documents are submitted to the head of the public service provider.
- No later than 5 working days from the receipt of the report from the probationary individual and the comments and evaluations from the probationary instructor, the head of the public service provider evaluates the political qualities, ethics, and work results of the probationary individual. If the probationary individual meets the requirements, the head of the public service provider shall decide within their authority or propose the competent authority managing the public service provider to decide on appointing the professional title and salary classification for the recruited public employee.
Thus, after the probationary period, probationary teachers must report probation results in writing. If they meet the requirements after the probationary period, they will be appointed to the professional title and salary for the working position.
Do teachers in the probationary period in Vietnam receive a salary?
Based on Article 23 of Decree 115/2020/ND-CP (amended by clause 13 Article 1 of Decree 85/2023/ND-CP) stipulating policies for probationary individuals and probationary instructors:

- During the probationary period, the probationary individual is entitled to 85% of the salary of level 1 of the recruited professional title.
In case the probationary individual has a degree higher than the training required for the recruited position, each higher qualification provides an additional salary level and the individual receives 85% of the salary coefficient of the appointed level. Allowances are granted as prescribed by law.
- The probationary individual is entitled to 100% salary and allowances of the professional title corresponding to the training level prescribed in clause 1 of this Article in the following cases:
a) Working in areas with particularly difficult socio-economic conditions;
b) Working in hazardous, dangerous sectors;
c) Completing military service; participating in people’s police duties; military officers, police officers, professional military personnel demobilized, cryptographic workers transferred to another sector, reserve officer students graduating from officer training, grassroots military commanding officer training graduates that have been ranked as reserve officers and registered in the reserve officer ranks, Youth Volunteers, young intellectuals volunteering to develop rural and mountainous areas for 24 months or longer who have completed their duties.
- The probationary period is not counted towards the salary raise consideration period.
- The probationary instructor is entitled to a responsibility allowance coefficient of 0.3 of the statutory pay rate during the probationary guidance period.
- During the probationary period, the probationary instructor and probationary individual are also entitled to other bonus and welfare policies (if any) as prescribed by the State and the public service provider's regulations.
Thus, teachers in the probationary period are entitled to 85% of the salary of level 1 of the recruited professional title.
In the case where the probationary individual has a degree higher than required, each additional degree level provides an additional salary level and the individual receives 85% of the salary coefficient of the appointed level, with allowances as per legal stipulations.
Probationary teachers are entitled to 100% of the salary and allowances for their respective professional title in cases such as working in areas with particularly difficult socio-economic conditions.
