Under Subsection 1, Section 3 of Circular 08/TT 1988 regarding reprimand in front of the class:

III. Disciplinary measures:

According to the Ministry's regulations, 05 disciplinary measuress against secondary school students who making mistakes in fulfilling their responsibilities are specifically applied as follows:

1. Reprimand in front of the class:

Students committing any of the following mistakes during the process of complying with the school's rules, responsibilities, and personal duties will be reprimanded in front of the class:

- Being absent without permission from 3 or more sessions within a month.

- Not memorizing lessons or doing homework, failing to prepare lessons as required by teachers 3 or more times in a month.

- Attending school late or not bringing required tools for work as stipulated by the school 3 or more times in a month.

- Using vulgar language, gambling (playing numbers games), smoking...

- Committing prohibited acts by the school even once, but having caused a certain harm to the school's comprehensive education efforts, such as cheating or helping others cheat during tests, displaying poor culture or unethical behavior towards teachers, parents, friends, and those around them, causing disunity in study groups, covering up or condoning wrongful acts of peers, failing to report to the school known wrongful acts for the school to promptly prevent, or other violations with equivalently damaging nature and degree.

- The decision to reprimand in front of the class will be made by the homeroom teacher after consulting with leaders of the Ho Chi Minh Communist Youth Union of class and class leaders, and announced promptly during weekly class meetings, after which the homeroom teacher will report to the Principal for awareness and follow-up.

There are no disciplinary measures that involve imposing fines on students. Therefore, teachers are not allowed to impose fines on students.

What are the disciplinary measures against lower and upper secondary school students in Vietnam?

According to Clause 2, Article 38 of the lower secondary school, upper secondary school and multi-level school charter issued together with Circular 32/2020/TT-BGDDT, students making a mistake during the learning and training process shall be corrected or disciplined in the following ways:

- Give the student a reminder, directly support them in correcting their mistake.

- Reprimand the student, inform the student’s parent(s) to have the parent(s) cooperate in supporting the student in correcting their mistake.

- Suspend the student’s study at school for a definite period and take other correcting measures according to regulations from the Ministry of Education and Training.

What are the learning rights and obligations of lower and upper secondary school students in Vietnam?

Under Article 13 of the Education Law 2019, the learning rights and obligations of lower and upper secondary school students in Vietnam are regulated as follows:

- Learning is the right and obligation of every citizen. Every citizen, regardless of ethnic origin, religion, belief, gender, personal characteristics, family background, social status or economic conditions, has equal rights of access to learning opportunities.

- The State shall ensure social equality in education, create a safe educational environment, ensure inclusive education and enable learners to develop their potentials and talents.

- The State shall give priority in enabling children with special backgrounds as prescribed in the Children Law 2016, disabled and handicapped persons as prescribed in the Law on Persons with Disabilities 2010 and learners from poor and near-poor households to exercise their learning rights and obligations.
