What are the rights of 6th-grade students in Vietnam when attending school?
According to Article 83 of the Education Law 2019, the rights of 6th-grade students in Vietnam when attending school are as follows:
- Receive education and training so as to develop comprehensively and realize their potentials to the fullest.
- Receive respect; equal opportunities in education and learning; to have their talents, gifts, creations and inventions developed; to receive full information concerning their own learning and training.
- Have the possibility of leaping grades, shortening programme duration, learning at an age higher than regulated, extending programme duration or repeating class, be enabled to learn educational programmes as prescribed by law.
- Learn in a safe and healthy educational environment.
- Be awarded degrees/diplomas or certificates after completing educational levels, training qualifications or completing educational programmes as prescribed by law.
- Participate in collective activities in educational institutions in accordance with the law.
- Use infrastructure, libraries, equipment and facilities assigned to learning, cultural, sporting, athletic activities at educational institutions.

Article 33 of the regulations issued with Circular 32/2020/TT-BGDDT stipulates as follows:
Secondary school age
1. Children shall start the sixth grade at the age of 11 and the tenth grade at the age of 15. For students skipping a grade or over-age students, the sixth grade and tenth grade starting ages shall be adjusted based on the age at which these students graduate from the previous education level.
2. For ethnic minority students, students with disabilities, disadvantaged students and students returning to Vietnam from abroad, maximum secondary school starting age shall be 03 years older than the compulsory starting age.
3. At an education level, students may not repeat a grade more than 03 times.

Additionally, Article 33 of the regulations issued with Circular 28/2020/TT-BGDDT prescribes the age of primary school students as follows:
Age of Primary School Students
- The age of students entering first grade is 6. Disabled children, children who are physically or intellectually underdeveloped, children in particularly disadvantaged areas, ethnic minority children, orphans with no support, children returning from overseas, and children of foreigners studying or working in Vietnam may enter first grade at an older age than prescribed but not more than 3 years older. In cases where children enter first grade more than 3 years older than prescribed, the decision will be made by the head of the Education and Training Department.
- Primary school students may study at an age older than the prescribed age in cases of repeated grades, students in particularly disadvantaged areas, students belonging to ethnic minorities, students with disabilities, students who are physically or intellectually underdeveloped, orphans with no support, students returning from overseas, and other cases as prescribed by law.
Thus, the age for students entering 6th grade is 11 years. Students entering 6th grade who are ethnic minorities, have disabilities, face particularly difficult circumstances, or have returned from overseas may enter at an age 3 years older than prescribed.
For students allowed to skip grades in prior education levels or enter at an older age than prescribed, the age for entering 6th grade may be adjusted based on the age at which they graduated from the prior education level.
