Pursuant to the Law on Customs dated June 23, 2014;
At the request of the Ministry of Finance;
The Government promulgates a Decree amending Decree No.01/2015/ND-CP dated January 02, 2015 which specifies customs areas; responsibility for collaboration in preventing and controlling smuggling and illegal transportation of goods across borders
1. Appendix of customs areas designated at land and inland waterway border checkpoints in bordering areas issued together with Decree No.01/2015/ND-CP dated January 02, 2015 of the Government is replaced by the Appendix specifying customs areas designated at land and inland waterway border checkpoints in bordering areas issued together with this Decree.
2. Article 7 is amended as follows:
“Article 7. Specific customs areas designated at international post offices, areas used for express delivery of imports and exports
1. Specific customs areas designated at international post offices refer to areas located at points of postal service for imported, exported or stored posts from/to foreign countries in accordance with the International Agreements of the Universal Postal Union and regulations on posts in the Socialist Republic of Vietnam.
2. Specific customs areas designated in areas used for express delivery imports and exports refer to location for concentrated supervision, inspection and gathering of commodities imported and exported via express delivery.”
3. Clause 2 and 8 in Article 8 is amended as follows:
“2. Industrial zones, border-checkpoint economic zones where enterprises manufacture and trade goods under the customs supervision and control; free-trade zones, processing and exporting zones; office and goods warehouses of exporting and processing enterprises; free-trade zones; other customs preference-given areas; separate customs areas.
8. Areas and locations for physical verification of imported and exported products used at manufacturing, re-processing facilities and project sites
4. Clause 3 in Article 11 is amended as follows:
“3. Prevention, investigation, settlement of violations and violation dossier preparation”
5. Article 15 is amended as follows:
“Article 15. Collaboration in preventing, investigating, settling violations and preparing violation dossier
1. The customs authority shall take responsibility to cooperate and assist the border guard, coast guard, public security, market authorities and relevant agencies in application of measures for preventing, investigating and handling violations as well as preparing the dossier of violations relating to import and export activities as required.
2. During the application of measures for preventing, investigating, handling violations as well as preparing the violation dossier, after considering the request of the customs authority, the public security, border guard, coast guard, market authorities and relevant agencies are required to:
a) arrange human force to cooperate and support facilities in carrying out search on people, means of transport, articles and places used for storing exhibits or means of transport committing administrative violations according to the administrative procedure, and escort violators;
b) cooperate and support human force and means of transport in recording statements, collecting information, materials, evidences, and extending and setting up a commission of investigation;
c) cooperate with one another in preparing violation dossier as well as handling violations.”
6. Article 15a is added as follows:
“Article 15a. Collaboration on propaganda and dissemination of policies and laws
The customs authorities, as authorized and assigned, shall preside over and cooperate with People’s Committees of all levels, public security, border guard, coast guard, market authorities and relevant agencies in organizing the propaganda and disseminating policies and laws concerning prevention of smuggling, illegal transportation of goods across borders in the customs areas."
This Decree comes into force from March 10, 2018.
Article 3. Responsibilities for implementation
Ministers, Directors of ministerial agencies, Governmental agencies, Chairman of People's Committees of provinces and centrally-affiliated cities shall take responsibility to implement this Decree.
Where it is essential to amend or adjust the specific customs areas designated at land and inland waterway border checkpoints, the Ministry of Finance shall preside over and cooperate with the Ministry of National Defense, Industry and Trade and People’s Committees of provinces and cities at site in considering and submitting the proposals to the Government for approval./.
