THE MINISTER OF TRANSPORT
Pursuant to the Government’s Decree No. 123/2016/ND-CP dated September 01, 2016 defining the functions, tasks, entitlements and organizational structures of Ministries and ministerial agencies;
Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 defining the functions, tasks, entitlements and organizational structure of Ministry of Finance;
At the request of the Director General of the Vietnam Register in the Document No. 1192/TTr-DKVN dated April 23, 2020;
At the request of the Director General of the Department of Personnel and Organization.
HEREBY DECIDES:
Article 1. Position and functions
Register Office is an organization which is affiliated to Vietnam Register and exercises the functions of advising and assisting the Director General of Vietnam Register to perform state management of registration of road vehicles, loading and construction vehicles and equipment, containers for use in road, railway, inland waterways and maritime transport (hereinafter referred to as “transport vehicles and equipment”) and vehicles and equipment for exploration, extraction and transport at sea, machinery, equipment and supplies subject to strict occupational safety requirements (except for vehicles and equipment serving national defense and security purposes, and fishing vessels); organize the inspection of quality, technical safety, environmental safety and occupational safety for the said vehicles and equipment under regulations of law and within the scope of management as assigned by the Director General of the Vietnam Register.
Every Register Office has its own legal status, seal and account opened at the State Treasury and banks. Its headquarters is located in a province or central-affiliated city under the Decision No. 2836/QD-BGTVT dated October 05, 2017 of the Minister of Transport defining the functions, tasks, entitlements and organizational structure of Vietnam Register.
Article 2. Tasks and entitlements
1. Formulate and submit to the Director General medium-term and long-term, medium-term and annual plans to organize inspection of technical and environmental safety for vehicles and equipment under their management.
2. Organize implementation of, review and propose amendments to legislative documents, national standards and technical regulations relating to registration activities.
3. Organize the inspection of quality, technical safety, environmental safety and occupational safety for transport vehicles and equipment; vehicles and equipment for exploration, extraction and transport at sea and other vehicles and equipment under their management (except for vehicles and equipment serving national defense and security purposes, and fishing vessels), including:
a) Appraising designs during manufacturing, assembly, repair and modification of vehicles and equipment as prescribed by law and authorized by the Director General of Vietnam Register;
b) Inspecting, assessing and issuing certificates of technical and environmental safety during manufacturing, assembly, repair, modification, import, export and operation of vehicles, road vehicles, vehicles and equipment for exploration, extraction and transport at sea in accordance with regulations of law and relevant treaties to which the Socialist Republic of Vietnam is a signatory;
c) Inspecting, assessing and issuing certificates of maritime safety, security and labor management system under regulations of law and maritime safety, security and labor-related treaties to which the Socialist Republic of Vietnam is a signatory;
d) Inspecting and issuing certificates of technical safety and pollution prevention to foreign ships in accordance with international practice or at the request of Vietnamese competent authorities;
dd) Inspecting and issuing certificates of technical and environmental safety for loading and construction equipment, containers and equipment for packaging of hazardous goods for use in transport; machinery, equipment and supplies for use in transport vehicles and equipment during manufacturing, assembly, repair, restoration, modification, import and export;
e) Inspecting machinery, equipment and supplies subject to strict occupational safety requirements installed and used on transport vehicles and offshore units serving petroleum exploration and extraction; offshore oil and gas pipelines; loading vehicles and equipment subject to strict occupational safety requirements for specialized use in seaports, ports, landing stages, shipyards and railway vehicles;
g) Assessing technical conditions of transport vehicles and equipment, and vehicles and equipment for exploration, exploitation and transport at sea at the request of regulatory bodies or at the request of other organizations and individuals;
h) Participating in investigation into vehicle incidents and accidents at the request of regulatory bodies;
i) Organizing collection, payment, management and use of prices, fees and charges related to registration and other revenues as prescribed by law.
4. Organization communication and dissemination of laws on registration within areas under their management.
5. Organize assessment and issue notifications of facilities eligible for manufacturing, modification and repair of transport vehicles and equipment, and vehicles and equipment for exploration, extraction and transport at sea; maintenance, inspection and testing facilities serving registration as prescribed by law
6. Organize testing and issuance of certificates of welder’s qualification to watercraft building, modification and repair facilities.
7. Participate in providing professional and practical training to, assessing inspectors at the request of Vietnam Register.
8. Organize scientific research, development, application and transfer of technologies in the registration field; formulate and implement IT application programs, schemes and projects; build database and provide information services in favor of management and operation activities in the registration field.
9. Design and execute their own administrative reform programs according to the objectives and contents of the state administrative reform program of Vietnam Register.
10. Participate in amending and updating relevant professional procedures and guidelines and organize implementation and maintenance of quality management system according to ISO 9001 in relation to their tasks.
11. Manage their personnel, finance, assets and equipment as prescribed by law and assigned by the Director General of Vietnam Register.
12. Archive, manage and maintain confidentiality of their relevant files and documents as prescribed.
13. Perform other tasks as assigned by the Director General of Vietnam Register.
Article 3. Leaders and organizational structure
1. Leaders of a Register Office include a Director and several Deputy Directors.
a) The Register Office's Director is the head of the Register Office and responsible to the Director General of Vietnam Register and to the law for all operations of the Register Office. Register Office’s Deputy Directors are those who assist the Register Office’s Director, directly provide instructions and perform tasks as assigned by the Director; are responsible to the Director and to the law for the fields under their management.
b) The Register Office’s Director shall be appointed, dismissed, seconded and reassigned by the Director General of Vietnam Register. The Register Office’s Deputy Directors shall be appointed, dismissed, seconded and reassigned by the Director General of Vietnam Register at the request of the Register Office's Director.
2. Affiliated branches
a) Register Office No. 1 has 03 branches.
b) Register Office No. 4 has 01 branch.
c) Register Office No. 8 has 01 branch.
d) An Giang Register Office has 01 branch.
The Director General of Vietnam register shall define specific functions, tasks, entitlements and organizational structures of Register Offices affiliated to Vietnam Register at the request of Register Offices’ Directors.
Article 4. Effect and responsibility for implementation
1. This Decision comes into force from the day on which it is signed.
2. The Director General of Vietnam Register shall define specific tasks, entitlements and scope of management of each Register Office affiliated to Vietnam Register in a manner that is suitable for characteristics of the area under its management.
3. Chief of the Ministry Office, the Chief Inspector of the Ministry, Directors General of Departments, Director General of Vietnam Register and heads of agencies and units concerned are responsible for the implementation of this Decision./.
