Pursuant to the (2017) Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Vietnam;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some articles of the Law on foreign trade management;
For the purpose of the Free Trade Agreement between Vietnam and Eurasian Economic Union which has been ratified by the President of the Socialist Republic of Vietnam;
At the request of the Director of the Agency of Foreign Trade;
The Minister of Industry and Trade of Vietnam promulgates a Circular prescribing the application of import tariff-rate quotas for unmanufactured tobacco and poultry eggs originated from member states of Eurasian Economic Union in 2023 - 2027 period.
Import tariff-rate quotas shall be applied to unmanufactured tobacco and poultry eggs originated from member states of the Eurasian Economic Union under the Free Trade Agreement between Vietnam and the Eurasian Economic Union in 2023 - 2027 period.
This Circular applies to importers according to permitted tariff-rate quotas of unmanufactured tobacco and poultry eggs originated from member states of Eurasian Economic Union, and relevant authorities, organizations and individuals.
Article 3. Goods and import tariff-rate quotas
1. HS codes and import tariff-rate quotas in the 2023 - 2027 period of goods imported under the tariff-rate quotas as prescribed in Article 1 of this Circular are elaborated in the Appendix enclosed herewith.
2. Goods imported from the member states of Eurasian Economic Union under the Free Trade Agreement between Vietnam and the Eurasian Economic Union must be supported by C/O Form EAV issued in accordance with prevailing regulations.
1. The import tariff-rate quotas for unmanufactured tobacco shall be allocated to traders that hold valid license for manufacturing of cigarettes issued by the Ministry of Industry and Trade of Vietnam and wish to import unmanufactured tobacco to serve their manufacturing of cigarettes.
2. The import tariff-rate quotas for poultry eggs shall be allocated to traders that wish to import poultry eggs.
Methods for allocation of import tariff-rate quotas for unmanufactured tobacco and poultry eggs shall comply with the provisions of the Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade of Vietnam.
This Circular comes into force from April 10, 2023 to December 31, 2027 inclusively./.

Notes:
(*) Import tariff-rate quotas for poultry eggs imported from the member states of Eurasian Economic Union are different from Vietnam’s import tariff-rate quotas for poultry eggs in WTO commitments.
(**) Import tariff-rate quotas for unmanufactured tobacco and tobacco refuse imported from the member states of Eurasian Economic Union shall be applied in conformity with Vietnam’s international commitments, and domestic law regulations applicable to relevant tobacco products.
