Pursuant to subsection 1, Section II of the Plan 4779/KH-SGDDT in 2022 stipulating as follows:

1. Persons obliged to declare assets and income
The declaration of assets and income in 2022 includes: annual declaration, additional declaration and first declaration (if any).
Persons who are obliged to declare assets and income according to the provisions of the 2018 Law on Anti-corruption and Decree No. 130/2020/ND-CP of Vietnam, including:
- Persons obliged to declare assets and annual income (who have made the first declaration of assets): Director, Deputy Director and as prescribed at Point b, Clause 3, Article 36 of the 2018 Law on Anti-corruption and Article 10 of Decree No. 130/2020/ND-CP of Vietnam.
- Persons obligated to declare additional assets and income in 2022 (who have fulfilled the obligation to declare assets for the first time and excluding those who have made the annual declaration if above): are those who have fluctuations of assets and income in 2022 with a value of VND 300,000 (three hundred million Vietnam dong) or more compared to the previous declaration.
- Persons obliged to declare income assets for the first time: are those who hold the positions for the first time as prescribed in Clauses 1, 2 and 3, Article 34 of the 2018 Law on Anti-corruption.

Thus, according to the above regulations, subjects belonging to the Department of Education and Training and public service providers under the Department of Education and Training of Ho Chi Minh City are obliged to declare and disclose assets and income in 2022, including:
- Persons obliged to declare assets and annual income (who have made the first declaration of assets): Director, Deputy Director and as prescribed at Point b, Clause 3, Article 36 of the 2018 Law on Anti-corruption and Article 10 of Decree 130/2020/ND-CP of Vietnam.
- Persons obligated to declare additional assets and income in 2022 (who have fulfilled the obligation to declare assets for the first time and excluding those who have made the annual declaration if above): are those who have fluctuations of assets and income in 2022 with a value of VND 300,000 (three hundred million Vietnam dong) or more compared to the previous declaration.
- Persons who are obliged to declare income assets for the first time: are those who hold the working positions for the first time specified in Clauses 1, 2 and 3, Article 34 of the 2018 Law on Anti-corruption.

What forms of disclosure of assets and income in Vietnam are there?
Pursuant to subsection 3, Section II of Plan 4779/KH-SGDDT in 2022 stipulating as follows:
Depending on the actual situation, the unit chooses one of the following two forms:
- Form of public listing at the head office of the agency or unit:
+ The person is obliged to declare and disclose the declaration at the agency or unit where he/she regularly works.
+ The posting location must ensure safety and convenience for reading the declarations.
+ The listing must be made in writing, clearly stating the declarations to be posted, signed for certification by the head of the agency, unit and representative of the Trade Union.
+ Time to post the declaration is 15 days.
+ Implement Form 3 - Minutes of listing and Form 4 - Minutes of closing listing.
- Form of disclosure at the meeting:
+ The publicity at the meeting must ensure the following requirements: The meeting to disclose the declaration must ensure the presence of at least 2/3 of the people convened. The chairperson of the meeting himself or assigns a person to read the declarations or each person reads his/her own declaration. Minutes of the meeting must record the comments, questions and explanations about the content of the declaration (if any); signed by the chairperson of the meeting and the representative of the trade union of the agency, organization or unit.
+ Implement Form 5 - Public meeting attendance list and Form 6 - Public meeting minutes.
When is the deadline for performing the obligation of declaration and disclosure of assets and income in Vietnam?
Pursuant to Section III of the Plan 4779/KH-SGDDT in 2022 stipulating as follows:
Execution time
- Leaders of departments and divisions under the Department and Heads of units under the Department of Education and Training go to the link http://bctccb.hcm.edu.vn to enter the list of people who are obliged to declare assets, collect income annual import; declare assets and additional income and declare assets and income for the first time, and print the entered list and send it to the Personnel and Organization Department, Department of Education and Training from December 1, 2022 to December 6, 2022 for summary.
- On the basis of the entered list, leaders of departments and departments under the Department and heads of units under the Department of Education and Training deploy to the person who is obliged to declare and disclose assets, income in 2022 and must be completed by December 20, 2022.
Thus, according to the above regulations, the time to perform the obligation to declare and disclose assets and income will be completed before December 20, 2022.
