According to the provisions of Point a, Clause 1, Article 3 of the Regulations promulgated together with Circular 20/2022/TT-BGDDT on the legal position and types of the Center as follows:

Legal position and types of the Center
1. Legal position of the Center
a/ The center is an educational and training institution under the national education system. The center has legal status, has its own seal and account;
b) The center is managed by the Department of Education and Training.
2. The center is organized in two types: public and private
a) Public centers shall be invested by the State, ensuring operating conditions and representing owners;
b) Private centers shall be invested by domestic or foreign investors, ensuring operating conditions.

According to the above provisions:

- The inclusive education development support center is an educational and training institution under the national education system.

- The center has legal status, has its own seal and account;

- The center is managed by the Department of Education and Training.

In addition, the Center is organized into two types: public and private.

- Public centers shall be invested by the State, ensuring operating conditions and representing owners;

- Private centers shall be invested by domestic or foreign investors, ensuring operating conditions;

What are the duties and powers of inclusive education development support centers in Vietnam?

Pursuant to Clause 1, Article 5 of the Regulation promulgated together with Circular 20/2022/TT-BGDDT, inclusive education development support centers in Vietnam shall perform the following tasks:

- Assess, identify capability and classify educational needs for children with signs of disability or signs of functional impairment, students with disabilities for having early education intervention or counseling on choosing appropriate educational methods for each subject.

- Support inclusive education for students with disabilities.

- Organize teaching and education at preschool and general education levels for students with disabilities so that students with disabilities can participate in inclusive education or integrate with the community.

- Retrain and counsel people with disabilities and organizations, units and individuals with psychological, health, educational, and vocational demands.

- Exercise democratic regulations in the Centrer.

- Complete information, and reports and be responsibility for explaining to competent authorities, students, and society.

- Perform other duties as prescribed by law.

In addition, the inclusive education development support centers in Vietnam have the powers specified in Article 6 of the Regulation promulgated together with Circular 20/2022/TT-BGDDT as follows:

- Exercise autonomy in accordance with the provisions of law and the following specific provisions:

+ Decide on the center's goals, mission, strategy, and development plan;

+ Decide on the establishment of the organizational apparatus according to the center establishment scheme approved by the competent authority;

+ Plan, train and retrain and, develop the contingent of managers, teachers, and staff of the Center;

+ Perform financial revenues, expenditures, and investments in the development of conditions to ensure the quality of education in accordance with the provisions of law;

+ Enroll and manage students; develop the Center's educational program; organize the compilation and selection of learning materials, utensils, toys, and learning materials in accordance with the provisions of law;

+ Cooperate with domestic and foreign organizations and individuals to mobilize professional or financial resources to support the performance of the Center's duties in accordance with the provisions of the law.

- Use and manage the contingent of managers, teachers, and employees; organize teachers to update knowledge and improve professional capacity.

- Receive benefits in accordance with the law on encouraging socialization to assist people with disabilities in the education sector.

- Other powers as prescribed by law.

What is the organizational structure of inclusive education development support centers in Vietnam?

According to the provisions of Article 7 of the Regulation issued together with Circular 20/2022/TT-BGDDT on the organizational structure of inclusive education development support centers in Vietnam as follows:

The organizational structure of the Center includes:

- Director, deputy director;

- Functional/professional departments (or professional groups, administrative/office groups);

- Class (if any);

- Party organization and mass organizations (if any);

- Competition and reward council, disciplinary council, advisory council (if any).

Where:

- The Director of the Center is the person who directly manages and administers the apparatus organization and is responsible to the superior management agencies and the law. Each term is 05 years.

- The Deputy Director of the Center is the person who assists the director in managing and administering the activities of the Center. The number of deputy directors of the center establishment scheme approved by the competent authority. Each term is 05 years.

Circular 20/2022/TT-BGDDT will take effect from February 20, 2023.
