According to Article 16 of Circular 08/2022/TT-BKHDT stipulating the notice of invitation to bid, E-TBMT in online bidding in Vietnam is as follows:
- The bid solicitor shall post the notice of invitation for bids and E-TBMT on the System according to the schedule of the contractor selection organization and in accordance with the time of the contractor selection organization in the approved contractor selection plan. The modification and cancellation of the notice of invitation for bids and the E-TBMT shall be done only before the time of bid closing, unless no bidder has submitted the bid or E-HSDT.

Regarding issuance: During the posting of the notice of invitation to bid, the E-TBMT, the bid solicitor must attach the following documents:
+ Decision on approval of bidding documents, E-HSMT;
+ Approved bidding documents and E-HSMT;
- For non-online contractor selection, the bidding documents will be released on the System immediately after the successful posting of the invitation to bid. In case of selling the bidding documents (the electronic version has been released on the System), when submitting the bids, the contractor must pay the bid solicitor an amount equal to the selling price of the bidding documents as prescribed in Clause 1 of this Article. 9 of Decree No. 63/2014/ND-CP.
- The bid solicitor may not issue paper copies of bidding documents to contractors. In case the bid solicitor issues paper copies to contractors, the paper copies are not valid for preparation and evaluation of bids.
- In case the content of the bidding documents and E-HSMT posted on the System is different from the content of the approved bidding documents and E-HSMT, the bidding documents and E-HSMT will be issued. on the System is the basis for making and evaluating bids and E-HSDTs

How to upload documents to amend the invitation to bid?
According to Clause 2, Article 17 of Circular 08/2022/TT-BKHDT, regulating the amendment of bidding documents and E-HSMT in online bidding in Vietnam as follows:
- For non-online contractor selection, in case of modification of bidding documents after being released, the bid solicitor must upload documents in one of the following two ways on the System:
+ The decision to amend together with the revised contents of the bidding dossier;
+ The revised decision and the revised bid invitation document must clearly show the revised content in the revised bidding document.
- For online contractor selection, in case of modification of the E-HSMT after its issuance, the bid solicitor must upload the following documents on the System:
+ The decision to amend together with the revised contents of the E-HSMT;
+ E-HSMT has been revised.
How long must the bid solicitor clarify the contents of the online bidding in Vietnam documents?
According to Clause 2, Article 17 of Circular 08/2022/TT-BKHDT stipulating the clarification of bidding documents and E-HSMT in online bidding in Vietnam as follows:
- For non-online contractor selection, in case it is necessary to clarify the bidding documents, the contractor must send a request for clarification to the bid solicitor via the System at least 03 working days (for domestic bidding). ), at least 05 working days (for international bidding) before the bid closing date for consideration and handling.
+ For online contractor selection, in case it is necessary to clarify the E-HSMT, the contractor must send a request for clarification to the bid solicitor via the System at least 03 working days before the bid closing date to view. review and process.
- The bid solicitor receives the contractor's request for clarification and posts the clarification document of the bidding documents and E-HSMT on the System within at least 02 working days before the bid closing date. ;
- The content of clarification of the bidding documents and the E-HSMT must not be contrary to the contents of the approved bidding documents and E-HSMT. In case the receipt of the request for clarification of the bidding documents and the E-HSMT leads to the modification of the bidding documents and the E-HSMT, the modification of the bidding documents and the E-HSMT shall comply with the provisions of Clause 1 of this Article. Clause 2 of this Article on the basis of compliance with the time prescribed at Point m Clause 1 Article 12 of the Bidding Law and Point c Clause 2 Article 64 of Decree No. 63/2014/ND-CP;
- In case of necessity, the bid solicitor organizes a pre-bid conference to discuss the contents of the bidding documents and the E-HSMT that the bidders do not know. The bid solicitor posts the invitation to attend the pre-bid conference on the System. The content of the exchange between the bid solicitor and the contractor must be recorded in the minutes by the bid solicitor and posted on the System within a maximum of 02 working days from the end of the pre-bid conference.
Thus, the bid solicitor shall receive the contractor's request for clarification and post the clarification of the bidding documents on the System within at least 02 working days before the bid closing date.
Circular 08/2022/TT-BKHDT takes effect from August 1, 2022.
