Based on the provisions of Article 129 of the Housing Law 2023, organizations and individuals constructing housing must warranty the housing according to the provisions of the construction law; organizations and individuals providing housing equipment must warranty the equipment according to the period prescribed by the manufacturer.

In the case of investment in housing construction for sale or lease purchase, the seller or lessor is responsible for housing warranty according to the following warranty periods:

- For apartment buildings, the minimum period is 60 months from the completion of construction and acceptance for use;- For individual houses, the minimum period is 24 months from the completion of construction and acceptance for use.

Based on the provisions of Article 4 of the Housing Law 2023, there are 07 policies for the development, management, and use of housing.

The housing warranty content includes repair, rectification of damage to the frame, columns, beams, floors, walls, ceilings, roofs, terraces, stairs, finishing materials, the system providing fuels, daily electricity supply system, lighting electricity supply, water tanks and water supply system, septic tanks, and waste water and waste disposal systems. It remedies cases of tilting, sinking, cracking, subsidence of housing and other contents as agreed in the housing purchase or lease-purchase contract. For other equipment attached to the house, the seller or lessor shall perform warranty repair and replacement according to the manufacturer's prescribed warranty period.

Thus, the housing warranty content includes the aforementioned items.

When does the Housing Law 2023 take effect?

Based on the provisions of Article 197 of the Housing Law 2023 as follows:

Effectiveness

1. This Law takes effect from January 01, 2025.

2. The Housing Law No. 65/2014/QH13, which has been amended and supplemented by certain articles under Laws No. 40/2019/QH14, No. 61/2020/QH14, No. 62/2020/QH14, No. 64/2020/QH14, and Law No. 03/2022/QH15, expires when this Law comes into effect, except as stipulated in point b of clause 1, points a, c, d, e, and g of clause 2, clause 3, points a, b, c, d, e of clause 5, Article 198 of this Law.

3. Housing owned by the state as regulated by legal documents on housing issued before this Law takes effect is considered public property.

The Housing Law 2023 takes effect from January 01, 2025.

From January 01, 2025, the Housing Law 2014 officially expires, except for cases at point b of clause 1, points a, c, d, e, and g of clause 2, clause 3, points a, b, c, d, e of clause 5, Article 198 of the Housing Law 2023.
