From July 22, 2024, what are the procedures for awarding the "Artist of Merit" title at the Ministerial and Provincial Councils in Vietnam?

Based on Article 15 of Decree 61/2024/ND-CP, the procedures for awarding the title "Artist of Merit" at the Ministerial and Provincial Councils in Vietnam are regulated as follows:

(1) Publicly announce the list of individuals proposed for the "Artist of Merit" title on media under the management authority: Ministries' and central authorities' or local authorities' electronic portals or newspapers for 10 days from the date of receiving submissions from the grassroots-level Council to gather public opinions.

(2) Receive and handle public petitions within 15 days from the end of the public announcement period of the list of individuals proposed for the "Artist of Merit" title on media under the management authority: Ministries' and central authorities' or local authorities' electronic portals or newspapers.

(3) Review and evaluate each dossier proposed for the "Artist of Merit" title as per Article 8 of Decree 61/2024/ND-CP within 10 days from the date the Council's standing agency reports and requests opinions from Council members about the dossier.

(4) Within 10 days from the end of the Council's meeting, the standing agency is responsible for notifying in writing about the results of the "Artist of Merit" title evaluation of the Ministerial or Provincial Council to the grassroots-level Council.

Within 5 days from the date the grassroots-level Council receives the notification in writing about the results of the Ministerial or Provincial Council, the standing agency of the grassroots-level Council is responsible for notifying in writing the individuals whose dossiers were proposed for the titles "People's Artist" or "Artist of Merit".

(5) Receive and handle petitions within 20 days from the date of announcing the Council's evaluation results.

(6) Within 10 days from the end of the petition reception and handling period, complete the dossier for proposing the "People's Artist" or "Artist of Merit" title, achieving at least 80% approval from the attending Council members, and send one set of the dossier to the standing agency of the State-level Council. The dossier (one set) includes:

+ Documents specified in points a, b, c, d, đ, e, and h, clause 6, Article 14 of Decree 61/2024/ND-CP;

+ Evaluation report of the Ministerial or Provincial Council for each individual considered as per point đ, clause 4, Article 8 of Decree 61/2024/ND-CP: Sample 8b in Appendix I enclosed with Decree 61/2024/ND-CP;

+ Decision to establish the Ministerial or Provincial Council.

(7) The time for organizing the evaluation of "Artist of Merit" titles at the Ministerial or Provincial Councils shall not exceed 85 days.

What are the standards for awarding the "Artist of Merit" title in Vietnam?

Based on Article 8 of Decree 61/2024/ND-CP, the standards for awarding the "Artist of Merit" title are as follows:

(1) Loyalty to the Fatherland; good compliance with the policies of the Communist Party, and the laws and policies of the State; adhering to the rules and regulations of the agency, organization, and locality.

(2) Having good moral character, exemplary in life, dedicated to the profession; possessing outstanding artistic talent in the cultural and artistic fields honored; having professional prestige; having a spirit of serving the people, and being recognized and admired by colleagues and the people.

(3) Continuously or cumulatively working in the field of professional culture and arts for 15 years or more, or 10 years or more for circus and dance arts.

(4) Meeting one of the following criteria:

- Having at least 02 national Gold Awards, of which 01 is an individual national Gold Award.

+ Domestic Gold Awards for individuals or for films, programs, plays, and performances are converted to individual achievements as regulatory in Appendix II attached to Decree 61/2024/ND-CP.

+ International awards for individuals or for films, programs, plays, and performances shall be considered by the competent authority on cultural and artistic activities of the Ministry of Culture, Sports and Tourism and documented for individual achievement calculation according to Appendix II attached to Decree 61/2024/ND-CP.

- Having at least 01 national Gold Award and 02 national Silver Awards, wherein 01 of the Gold Awards must be individual.

+ Domestic Gold Awards for individuals or for films, programs, plays, and performances are converted to individual achievements as regulatory in Appendix II attached to Decree 61/2024/ND-CP.

+ International awards for individuals or for films, programs, plays, and performances shall be considered by the competent authority on cultural and artistic activities of the Ministry of Culture, Sports and Tourism and documented for individual achievement calculation according to Appendix II attached to Decree 61/2024/ND-CP.

+ The conversion rate of national Silver Awards for individuals or for films, programs, plays, and performances shall be calculated similarly to national Gold Awards conversion rates.

- In the absence of an individual national Gold Award, having at least 03 national Gold Awards converted for individuals as regulatory in Appendix II attached to Decree 61/2024/ND-CP.

+ Domestic Gold Awards for individuals or for films, programs, plays, and performances are converted to individual achievements as regulatory in Appendix II attached to Decree 61/2024/ND-CP.

+ International awards for individuals or for films, programs, plays, and performances shall be considered by the competent authority on cultural and artistic activities of the Ministry of Culture, Sports and Tourism and documented for individual achievement calculation according to Appendix II attached to Decree 61/2024/ND-CP.

- Having at least 02 national Gold Awards for musical or photographic works.

+ Domestic Gold Awards for musical or photographic works are converted according to the regulatory conversion rate in Appendix II attached to Decree 61/2024/ND-CP.

+ International awards for musical or photographic works shall be considered by the competent authority on cultural and artistic activities of the Ministry of Culture, Sports and Tourism and documented for individual achievement calculation according to Appendix II attached to Decree 61/2024/ND-CP.

- Outstanding contributions, exceptional artistic talent, not meeting the criteria in point a or point b or point c, clause 4, Article 8 of Decree 61/2024/ND-CP, but considered and agreed by the Councils to propose to the Prime Minister for specific cases as follows:

+ Individuals are elderly as defined in Article 2 of Elderly Law 2009; have an additional 10 years of professional artistic activity compared to the provisions of clause 3 Article 8 of Decree 61/2024/ND-CP; have many exceptional contributions to the honored artistic forms, especially during the revolutionary resistance period;

+ Individuals have an additional 10 years of professional artistic activity compared to the provisions of clause 3 Article 8 of Decree 61/2024/ND-CP; have many exceptional contributions to the honored artistic forms; and are still actively participating in professional art performances and political activities at the provincial, city, ministerial, or national level;

+ Individuals have an additional 10 years of professional artistic activity compared to the provisions of clause 3 Article 8 of Decree 61/2024/ND-CP; have many exceptional contributions to the honored artistic forms; are still actively participating in professional art performances in symphonic music, opera, musicals;

+ Individuals are teachers, lecturers at professional cultural and artistic schools; have directly trained from 03 students, of which at least 02 students achieved Gold Awards and 01 student achieved a Silver Award at national and international art competitions (international student awards are considered and documented by the competent authority of the Ministry of Culture, Sports and Tourism for the teacher's or lecturer's achievement calculations). They are still actively participating in professional art performances and have many distinguished contributions in the honored artistic forms, or have an additional 10 years of professional artistic activity compared to the provisions of clause 3 Article 8 of Decree 61/2024/ND-CP, still actively participating in professional art performances and political activities at the provincial, city, ministerial, or national level.

What is the interval between two events of considering awarding, announcing, and awarding the "Artist of Merit" title in Vietnam?

Based on Article 5 of Decree 61/2024/ND-CP, the the interval between two events of considering awarding, announcing, and awarding the "Artist of Merit" title in Vietnam is regulated as follows:

- The titles "People's Artist" and "Artist of Merit" are awarded and announced according to clause 4, Article 66 of Emulation and Commendation Law 2022.
