Vietnam: Which holidays and festivals do employees get off from work in 2024?

Based on Article 112 of the Labor Code 2019, the regulations are as follows:

Holidays and Tet

1. Employees are entitled to take leave with full pay on the following holidays and festivals:

a) New Year’s Day: 1 day (January 1st of the Gregorian calendar);

b) Lunar New Year: 5 days;

c) Victory Day: 1 day (April 30th of the Gregorian calendar);

d) International Labor Day: 1 day (May 1st of the Gregorian calendar);

e) National Day: 2 days (September 2nd of the Gregorian calendar and 1 adjacent day);

f) Hung Kings' Commemoration Day: 1 day (March 10th of the Lunar calendar).

2. Foreign employees working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to one traditional holiday of their country and one National Day of their country, with pay.

3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam determines the specific holidays mentioned in points b and e of Clause 1 of this Article.

Accordingly, in 2024, there are 11 public holidays for employees on 6 holidays as follows:

(1) New Year’s Day: 1 day (January 1st of the Gregorian calendar);

(2) Lunar New Year: 5 days;

(3) Victory Day: 1 day (April 30th of the Gregorian calendar);

(4) International Labor Day: 1 day (May 1st of the Gregorian calendar);

(5) National Day: 2 days (September 2nd of the Gregorian calendar and one adjacent day);

(6) Hung Kings' Commemoration Day: 1 day (March 10th of the Lunar calendar).

Additionally, foreign employees working in Vietnam are entitled to one traditional holiday of their country and one National Day of their country, with pay, in addition to the stated holidays.

How is the salary calculated for working on holidays and Tet holiday in Vietnam?

Pursuant to Article 98 of the Labor Code 2019, the regulations on overtime and night work pay are as follows:

Overtime and night work payment

1. Employees working overtime are paid according to the hourly wage or current wage as follows:

a) On regular days, at least 150%;

b) On weekly rest days, at least 200%;

c) On public holidays, Tet, or paid leave days, at least 300% excluding the regular wage on those days.

2. Employees working at night are paid an additional amount of at least 30% of the wage calculated based on the regular daily wage.

3. Employees working overtime at night are, in addition to payments as specified in Clauses 1 and 2 of this Article, paid an extra 20% of the wage calculated based on the regular daily or weekly rest day wage, or holiday and Tet wage.

4. The Government of Vietnam provides detailed regulations for this Article.

In case employees work on holidays or Tet, they are entitled to a wage of at least 300% excluding the regular wage for the holiday.

Additionally, if employees work at night, they will be compensated with at least 30% of the regular daily wage and 20% of the holiday wage.

Therefore, working on holidays, the wage is calculated as follows:

- Working during the day: Receive at least 400% of the wage.

- Working at night: Receive at least 490% of the wage.
