What are the procedures on household division in Vietnam in 2023?

Pursuant to the provisions in Subsection 1, Section 1, Part C of the Administrative Procedures issued with Decision 5548/QD-BCA-C06 of 2021, the procedures on household division are as follows:

- Step 1: Individuals and organizations prepare documents according to the provisions of law.

Documents include:

- Separate households to register permanent residence at the same legal residence, documents include:

Declaration of change of residence information (Form CT01 issued with Circular 56/2021/TT-BCA), clearly stating the consent of the household head and legal residence owner to separate households, except where written consent has been given.

- In case the household member registering to separate is a divorced husband or wife who still lives in the same legal residence, the dossier includes:

+ Declaration of change of residence information (Form CT01 issued with Circular 56/2021/TT-BCA);

+ Papers and documents proving the divorce and continued use of that legal residence.

- Step 2: Individuals and organizations submit documents to the commune-level police.

- Step 3: When receiving the household division application, the residence registration agency checks the legality and content of the application:

+ In case the dossier is complete and valid, the dossier will be received and issued with an appointment to return the results (form CT04 issued with Circular 56/2021/TT-BCA) to the registrant;

+ In case the application meets the conditions but is not complete, instructions on supplementing and completing the application will be issued and instructions for supplementing and completing the application will be issued (form CT05 issued with Circular 56/2021/TT-BCA) to the registrant;

+ In case the application does not meet the conditions, refuse and issue a refusal to receive and process the application (form CT06 issued with Circular 56/2021/TT-BCA) to the registrant.
