Vietnam: How many prohibited acts in land border areas are there under the Decree 34/2014/ND-CP?

Pursuant to Decree 34/2014/ND-CP promulgating the regulation on land border areas of the Socialist Republic of Vietnam.

Pursuant to Article 4 of Decree 34/2014/ND-CP, there are 09 prohibited acts in land border areas.

As follows:

Prohibited acts in land border areas
1. Damaging, destroying, moving, or causing loss of, landmarks or signs to identify the borderline; “border area”, “border belt” and “restricted zone” signboards; and border works.
2. Changing the natural flow, exhausting water sources of, causing inundation, flooding or environmental pollution in, border rivers and streams.
3. Illegally inhabiting, exploiting forest products, exploring and exploiting minerals and aquatic resources.
4. Traveling across the border for field or terrace field farming, hunting or cattle grazing.
5. Burying corpses, removing graves; transporting corpses, remains, animals, plants and animal carcasses across the border without permission of competent Vietnamese state agencies.
6. Making gunshots across the border, causing explosions, cutting and burning trees for land reclamation in the border belt.
7. Shooting films, taking photos, recording sounds, surveying or drawing landscapes at places where ban signs are displayed in land border areas.
8. Smuggling, illegally transporting goods across the border, committing trade frauds.
9. Other prohibited acts prescribed by Vietnamese law and agreements on border regulations signed by the Socialist Republic of Vietnam with bordering countries.

Thus, there are prohibited acts in land border areas mentioned above.

What are land border areas of Vietnam?

Pursuant to Clause 1, Article 3 of Decree 34/2014/ND-CP:

1. Land border areas of the Socialist Republic of Vietnam (below referred to as land border areas) include communes, wards and townships (below referred to as communes) which have part of their administrative boundaries overlapping the national land borderline.
The, list of land border communes, wards and townships is provided in the Appendix to this Decree.
2. Border belt means a territorial section measured from the national borderline inward and established to manage and control activities of people and vehicles in the border belt and maintain security and order and prevent and combat illegal acts; and having a width of between 100 and 1,000 meters. The width of the border belt in special cases shall be decided by the Prime Minister.

Thus, according to the above regulations, the land border area of the Socialist Republic of Vietnam includes communes, wards and towns whose administrative boundaries partly coincide with the national land border.

What are State policies on border defense in Vietnam?

Pursuant to the provisions in Article 3 of the Law on Vietnam Border Guard 2020 as follows:

State policies on border defense
1. Implement independent, sovereign, unified, and territorial integrity policies; build peaceful, friendly, cooperative, and development-oriented borders with countries sharing the border; expand international cooperation, defense diplomacy, security, border diplomacy, and people-to-people diplomacy.
2. Resolve national border issues through peaceful means on the basis of respecting independence, sovereignty, unity, territorial integrity, and legitimate interests, in accordance with the Constitution, Vietnamese laws, and international treaties of which the Socialist Republic of Vietnam is a member.
3. Use appropriate and legitimate measures to protect the independence, sovereignty, unity, and territorial integrity of the Fatherland.
4. Implement the policy of national unity; build a strong and widespread national border defense force, with the people as the subject and the armed forces as the core.
5. Consolidate and strengthen national defense and security; prioritize resource investment, modernization of border infrastructure, and the development of the economy, culture, society, science, technology, and foreign relations in the border areas.
6. Mobilize resources from agencies, organizations, and individuals in carrying out border defense tasks.
7. Encourage and create conditions for agencies, organizations, and individuals to support material, financial, and spiritual resources for border defense tasks on a voluntary basis, in accordance with Vietnamese laws and international laws.

Currently, the State has the aforementioned policies regarding border defense.
