Examiner, Court Clerk Must Meet What Criteria to Be Officially Assessed as Outstandingly Accomplishing Their Duties?
What Criteria Must an Examiner Meet to Be Officially Evaluated as "Outstanding Performance"?
Pursuant to the provisions in Clause 1, Article 13 of the Regulations promulgated with Decision 01/QD-TAND of 2019, the contents are as follows:
Officials who do not hold leadership or management positions and meet all the following criteria will be classified and evaluated as having "Outstanding Performance":
- Always exemplary, strictly adhering to the policies and guidelines of the Communist Party and the laws of the State;- Possessing good political qualities, morals; maintaining a healthy lifestyle, strictly adhering to the discipline and regulations within the unit; diligent, responsible in performing assigned tasks;- Having professional competence and expertise, working effectively with colleagues, agencies, and related organizations in performing tasks;- Proactive and creative in performing assigned tasks;- Displaying proper attitude and cultural conduct in performing tasks; effectively preventing and combating acts of power abuse, authoritarianism, causing difficulties, negativity, corruption, and wastefulness;- Completing 100% of the tasks according to the annual work plans, ensuring progress, quality, and efficiency;- Promptly and effectively completing unexpected tasks;- Having scientific works, projects, articles published in legal journals, or initiatives effectively applied in public service activities, such as: Participating in drafting application guidelines for the People's Courts; participating in the adjudication and resolution of large, key, complex cases; proposing judgment decisions that are recognized as precedents by competent authorities, recognized by the unit's leadership.
To be specific, Examiners must not exhibit any of the following behaviors:
- Failing to meet the monthly, quarterly, and yearly professional and operational targets set by the agency or unit without justifiable reasons;- Violating regulations in requesting, collecting, and receiving documents and evidence submitted by the involved parties;- Negligence leading to proposals, reports, decisions, official letters, and other documents drafted by the Examiner containing numerous errors, affecting the quality of case resolution;- Delaying the drafting and preparation of proposals, decisions, reports, official letters, and other documents when directed by the authority, affecting the progress of handling the case;- Removing case files, documents from the office, or copying documents without being assigned or without the consent of the authority;- Neglecting responsibilities in implementing regulations on issuing, handing over, sending, or notifying decisions, procedural documents, and criminal enforcement documents, affecting the rights and legitimate interests of the involved parties, defendants, convicted persons, and relevant stakeholders;- Violating other rules and regulations of the People's Supreme Court regarding the duties and responsibilities of an Examiner.

To be specific, a Court Clerk must not exhibit any of the following behaviors:
- Refusing to accept petitions or requests for case resolution contrary to legal regulations;- Failing to make records, receipts, or appointment notes for the petitioner, failing to record the receipt number, or not forwarding petitions to the authority for review as per legal regulations, affecting the legitimate rights and interests of agencies, organizations, and individuals;- Removing case files, documents from the office, or copying documents without being assigned or without the consent of the authority;- Neglecting responsibilities in implementing regulations on issuing, handing over, sending, or notifying decisions and procedural documents as per legal regulations, affecting the rights and legitimate interests of the involved parties, defendants, convicted persons, and relevant stakeholders;- Falsifying records of trial proceedings, reconciliation sessions, meetings, statements, and other records when assigned by the authority, affecting case resolution outcomes;- Violating other rules and regulations of the People's Court regarding the duties and responsibilities of a Court Clerk.
What Criteria Must Court Leaders Meet to Be Evaluated as "Outstanding Performance"?
Pursuant to the provisions in Clause 2, Article 13 of the Regulations promulgated with Decision 01/QD-TANDTC of 2019, the criteria are as follows:
Officials holding leadership or management positions who meet all the following criteria will be classified and evaluated as having "Outstanding Performance":
- Truly exemplary in political ideology, ethical lifestyle, working style, and discipline according to Regulation No. 89-QD/TW dated August 4, 2017, of the Central Committee;- Performing well the duties assigned according to Regulation No. 89-QD/TW dated August 4, 2017, of the Central Committee;- Effectively leading, managing, and executing assigned tasks, ensuring progress, quality, and efficiency;- Excelling in advising, planning, drafting normative legal documents, and law enforcement;- Resolving petitions, complaints, and denunciations of organizations and citizens according to legal conformity;- Gathering and building a united and cohesive unit;- Ensuring that the led unit meets all targets and tasks, with at least 50% exceeding basic completion levels, and 100% of agencies and units under direct leadership and management being rated as completing tasks, with at least 70% completing good tasks or better;- Having scientific works, projects, articles published in legal journals, or initiatives effectively applied in public service activities, such as: Participating in drafting application guidelines for the People's Courts; participating in the adjudication and resolution of large, key, complex cases; proposing judgment decisions that are recognized as precedents by competent authorities, recognized by the unit's leadership.
