In what cases is the license to practice medical examination and treatment in Vietnam?

Pursuant to Clause 1, Article 30 of the Law on Medical Examination and Treatment 2023 as follows:

New issuance of practice licenses
1. New issuance of practice licenses shall apply to the following cases:
a) The person who first applies for a practicing license;
b) The practitioner changes the professional title stated on the practice license;
c) The person whose practice license is revoked in the case of new issuance according to the Government's regulations;
d) Other cases as prescribed by the Government.

Thus, an individual is granted a new license to practice medical examination and treatment when it falls into one of the following cases:

- The person who first applies for a license to practice;

- The practitioner changes the professional title stated on the license;

- Persons whose practice licenses are revoked in case of new issuance according to the Government's regulations;

- Other cases as prescribed by the Government.

What are the conditions for issuing a new medical license in Vietnam?

Pursuant to Clause 2, Article 30 of the Law on Medical Examination and Treatment 2023 stipulates as follows:

New issuance of practice licenses

2. Conditions for granting new practice licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency workers and clinical psychologists include:
a) Be assessed for professional capacity through examination and assessment of medical examination and treatment capacity specified in Article 24 of this Law or have a recognized practice license as prescribed in Article 29 of this Law;
b/ Having sufficient health to practice;
c/ Meeting Vietnamese language proficiency for foreigners as prescribed by the Government;
d) Not falling into one of the cases specified in Article 20 of this Law or being sanctioned for administrative violations of medical examination and treatment acts without a practice license but not yet expired is considered to have not been sanctioned for administrative violations.
3. Conditions for granting new practice licenses for medical titles, persons having heirloom remedies or heirloom healing methods include:
a/ Having a certificate of medical salary or a certificate of a person having heirloom remedies or a certificate of a person having heirloom healing methods;
b) Satisfy the conditions specified at Points b, c and d, Clause 2 of this Article.

Accordingly, for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency workers and clinical psychologists, the conditions for granting new practice licenses are as follows:

- Be assessed for professional capacity through examination and assessment of medical examination and treatment capacity or have an acknowledged practice license;

- Be healthy enough to practice;

- Meet Vietnamese language proficiency for foreigners according to the Government's regulations;

- Not falling into one of the cases specified in Article 20 of the Law on Medical Examination and Treatment 2023 or being sanctioned for administrative violations of medical examination and treatment acts without a practice license but not yet expired is considered to have not been sanctioned for administrative violations.

For medical titles, people with heirloom remedies or heirloom healing methods, the conditions for granting practice licenses are as follows:

- Having a certificate of medical salary or a certificate of a person with an heirloom remedy or a certificate of a person with an heirloom cure;

- Be healthy enough to practice;

- Meet Vietnamese language proficiency for foreigners according to the Government's regulations;

- Not falling into one of the cases specified in Article 20 of the Law on Medical Examination and Treatment 2023 or being sanctioned for administrative violations of medical examination and treatment acts without a practice license but not yet expired is considered to have not been sanctioned for administrative violations.

Which agency does the authority to issue new practice licenses in Vietnam belong to?

Pursuant to Article 28 of the Law on Medical Examination and Treatment 2023, it provides as follows:

- The Ministry of Health of Vietnam shall grant new practice licenses for the titles of doctors, physicians, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency workers and clinical psychologists for people working at medical examination and treatment establishments under their management;

- The Ministry of National Defense of Vietnam shall grant new licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency workers and clinical psychologists for persons working at medical examination and treatment establishments under its management;

- The Ministry of Public Security of Vietnam shall grant new practice licenses for the titles of doctors, nurses, midwives, medical technicians, clinical nutritionists, out-of-hospital emergency workers and clinical psychologists for people working at medical examination and treatment establishments under their management;

- Specialized health agencies under provincial-level People's Committees shall grant new practice licenses for professional titles specified in Clause 1, Article 26 of the Law on Medical Examination and Treatment 2023, except for the cases specified at Points a, b and c, Clause 1, Article 28 of the Law on Medical Examination and Treatment 2023.

The Law on Medical Examination and Treatment 2023 will take effect from January 1, 2024.
