Verification of Motor Vehicle Design Dossiers in the Field of Inspection to be Conducted Online from August 15, 2022
Current Regulations on Appraisal of Design Dossiers for Motor Vehicles
According to Article 5 of Circular 30/2011/TT-BGTVT on the appraisal of design dossiers for motor vehicles as follows:
"Article 5. Design Appraisal
1. The design dossier for motor vehicles must be appraised by the Quality Management Authority.
2. Design appraisal involves reviewing and cross-checking the contents of the product design dossier against the standards, technical regulations, and current regulations of the Ministry of Transport for motor vehicles to ensure that the produced and assembled products meet the quality, technical safety, and environmental protection requirements.
3. For design dossiers that meet the requirements, the Quality Management Authority shall issue a design appraisal certificate as per the form specified in Appendix III attached to this Circular.
4. Once the design appraisal certificate is issued, the design dossier shall be distributed as follows: one set to the design facility, one set to the production facility, and one set retained by the Quality Management Authority.
5. Amendments and supplements to the design dossier
a) In case of changes or supplements to the product design compared to the appraised design dossier, the production or design facility must submit a written request along with the amended or supplemented design dossier to the Quality Management Authority for appraisal of the amended or supplemented contents.
b) The design facility must prepare a new design dossier if the amendments and supplements do not meet the product requirements of the same type specified in Appendix I attached to this Circular.
6. Design appraisal procedures
a) Procedures for implementation:
- The design or production facility (if eligible to self-design products) shall prepare and submit one set of the design appraisal dossier directly or via the postal system to the Vietnam Register.
- The Vietnam Register shall receive and check the dossier's components: if the dossier is incomplete per the regulations, they shall guide the facility to complete it; if complete, they shall issue a receipt specifying the time for returning the design appraisal result.
- The Vietnam Register shall appraise the design dossier: if the design dossier does not meet the requirements, they shall notify for supplementation and adjustment; if the design dossier meets the requirements, they shall issue a Design Appraisal Certificate.
b) Method of implementation:
The facility shall submit the design appraisal request dossier and receive the results directly at the headquarters of the Vietnam Register or via the postal system.
c) The design appraisal request dossier includes:
- One original design appraisal request document;
- Three design dossiers (as stipulated in Clause 1, Article 4);
- One copy of the business registration certificate of the design facility (for the first-time design appraisal cases of the design facility) specifying that the enterprise has the function of designing motor vehicles (certified copy or photocopy with the design facility's confirmation).
d) Time limit for resolution:
The time for appraising the design dossier and issuing the design appraisal certificate shall not exceed 15 days from the date of receiving the complete dossier as per regulations."

According to Clause 2, Article 1 of Circular 16/2022/TT-BGTVT amending the Circulars in the registration field as follows:
"Article 1. Amendments and supplements to certain articles of Circular 30/2011/TT-BGTVT dated April 15, 2011, of the Minister of Transport providing for quality, technical safety, and environmental protection inspection in the production and assembly of motor vehicles (hereinafter referred to as Circular 30/2011/TT-BGTVT) and Circular 54/2014/TT-BGTVT dated October 20, 2014, of the Minister of Transport amending and supplementing certain articles of Circular 30/2011/TT-BGTVT dated April 15, 2011, of the Minister of Transport providing for quality, technical safety, and environmental protection inspection in the production and assembly of motor vehicles (hereinafter referred to as Circular 54/2014/TT-BGTVT).

2. Amending and supplementing Clause 4, Article 5 as follows:
“4. The design facility receives the design appraisal results as follows:
a) In case of direct receipt at the Quality Management Authority's headquarters or via postal system: one Design Appraisal Certificate; one technical design explanation and one technical drawing (one copy in case the design facility is also the production facility or two copies if the design facility differs from the production facility) of the design dossier.
b) In case of receipt via the online public service system: an electronic copy of the Design Appraisal Certificate; an electronic copy of the technical design explanation and the technical drawing of the design dossier.”
Amendments and Supplements to Design Appraisal Procedures in the Design Dossier for Motor Vehicles?
According to Clause 3, Article 1 of Circular 16/2022/TT-BGTVT amending the Circulars in the registration field as follows:
"Article 1. Amendments and supplements to certain articles of Circular 30/2011/TT-BGTVT dated April 15, 2011, of the Minister of Transport providing for quality, technical safety, and environmental protection inspection in the production and assembly of motor vehicles (hereinafter referred to as Circular 30/2011/TT-BGTVT) and Circular 54/2014/TT-BGTVT dated October 20, 2014, of the Minister of Transport amending and supplementing certain articles of Circular 30/2011/TT-BGTVT dated April 15, 2011, of the Minister of Transport providing for quality, technical safety, and environmental protection inspection in the production and assembly of motor vehicles (hereinafter referred to as Circular 54/2014/TT-BGTVT).

3. Amending and supplementing the first point of Clause 6(a) of Article 5 as follows:
“- The design or production facility, if eligible to self-design products (hereinafter referred to as the design facility), shall prepare and submit one set of the design appraisal dossier directly, via the postal system, or via the online public service system to the Vietnam Register.”
4. Amending and supplementing points b, c, and d of Clause 6 of Article 5 as follows:
a) Amending and supplementing point b of Clause 6, Article 5 as follows:
“b) Method of implementation: the design facility shall submit the design appraisal request dossier and receive the results directly at the Vietnam Register's headquarters, via the postal system, or via the online public service system.”
b) Amending and supplementing point c of Clause 6, Article 5 as follows:
“Design appraisal request dossier:
- One original or electronic template of the design appraisal request document;
- One design dossier as per Clause 1 of Article 4 of this Circular when submitting via the online public service system. If submitting directly or via the postal system: besides submitting one set of the design dossier as per Clause 1 of Article 4 of this Circular, submit one additional set of documents as per points a and b, Clause 1 of Article 4 of this Circular (or two sets if the design facility differs from the production facility).”
c) Amending and supplementing point d of Clause 6, Article 5 as follows:
“d) Time limit for resolution: Appraisal of the design content shall be conducted within 8 working days from the date of receiving the complete dossier as per regulations. In case the design dossier's appraisal result meets the requirements (the design dossier meets the requirements), the Vietnam Register shall issue a Design Appraisal Certificate as per the form specified in Appendix III attached to this Circular within 3 working days from the date of the design dossier's appraisal result meeting the requirements.”
Thus, the appraisal of design dossiers for motor vehicles is conducted via the online public service system from August 15, 2022.
Circular 16/2022/TT-BGTVT is effective from August 15, 2022.
