Which subjects are eligible for the adjustment of pension, social insurance allowance, and monthly allowance as anticipated?

Which Subjects are Expected to Have their Pensions, Social Insurance Benefits, and Monthly Allowances Adjusted?

In Article 1 of the Draft Decree on Adjusting Pensions, Social Insurance Benefits, and Monthly Allowances, the subjects eligible for adjustments include those receiving pensions, social insurance benefits, and monthly allowances before July 01, 2024, including:

(1) Officers, officials, workers, public employees, and laborers (including those participating in voluntary social insurance, those retiring from the Nghe An farmers' social insurance fund transferred as per Decision 41/2009/QD-TTg); soldiers, public security officers, and cipher officers currently receiving monthly pensions.

(2) Commune-level officials and civil servants as stipulated in Decree 33/2023/ND-CP, Decree 92/2009/ND-CP, Decree 34/2019/ND-CP, Decree 121/2003/ND-CP, and Decree 09/1998/ND-CP.

(3) Individuals currently receiving monthly labor incapacitation benefits as per the law; those receiving monthly benefits per Decision 91/2000/QD-TTg, Decision 613/QD-TTg in 2008; rubber workers currently receiving monthly benefits per Decision 206-CP in 1979.

(4) Commune-level officials currently receiving monthly benefits per Decision 130-CP in 1975 and Decision 111-HDBT in 1981.

(5) Soldiers currently receiving policies for monthly benefits per Decision 142/2008/QD-TTg (amended and supplemented by Decision 38/2010/QD-TTg).

(6) Public security officers currently receiving monthly benefits per Decision 53/2010/QD-TTg.

(7) Soldiers, public security officers, cipher officers receiving salaries equivalent to soldiers and public security officers currently receiving monthly benefits per Decision 62/2011/QD-TTg.

(8) Individuals currently receiving monthly work accident and occupational disease allowances.

(9) Individuals currently receiving monthly death allowances before January 01, 1995.

Additionally, the subjects specified in (1), (2), (3), (4), (5), (6), and (7), who retired and receive pensions, social insurance benefits, and monthly allowances before January 01, 1995, if their pension, social insurance benefit, and monthly allowance fall below 3,500,000 VND/month after adjustments as per Clause 1, Article 2 of the Draft Decree.

Which Agency Currently Disburses Pensions?

Pursuant to Article 93 of the Law on Social Insurance 2014:

Social Insurance Agency

1. The social insurance agency is a state agency that performs policies, social insurance policies, manages and utilizes social insurance funds, health insurance, and unemployment insurance funds; inspects the payment of social insurance, unemployment insurance, health insurance, and other duties as prescribed by this Law.

2. The Government of Vietnam specifies the organization, duties, and powers of the social insurance agency.

Thus, the social insurance agency is the state agency that executes policies, manages, and utilizes social insurance funds, health insurance funds, and unemployment insurance funds.

The social insurance agency will disburse pensions to eligible recipients.

Can Pensions Be Received Directly at the Social Insurance Agency?

Pursuant to Article 18 of the Law on Social Insurance 2014:

Rights of Employees

1. Participate in and enjoy social insurance benefits as prescribed by this Law.

2. Be issued and manage a social insurance book.

3. Receive pensions and social insurance benefits fully and promptly, through one of the following payment methods:

a) Directly from the social insurance agency or through an authorized service organization;

b) Through a bank account opened by the employee;

c) Through the employer.

4. Enjoy health insurance in the following cases:

a) When receiving a pension;

b) During the leave period for maternity benefits when giving birth or adopting a child;

c) When on leave to receive monthly benefits due to work accidents or occupational diseases;

d) When receiving sick leave benefits for employees suffering from diseases listed in the Ministry of Health's list of diseases requiring long-term treatment.

5. Be independently assessed for the extent of labor capacity reduction if falling under the provisions of point b, Clause 1, Article 45 of this Law and maintaining the social insurance payment period; receive reimbursement for medical assessment fees if eligible for social insurance benefits.

6. Authorize another person to receive pensions and social insurance benefits.

7. Every six months, receive information from the employer on social insurance contributions; annually, receive confirmation from the social insurance agency on social insurance contributions; request information from the employer and social insurance agency on social insurance contributions and benefits.

8. Lodge complaints, denunciations, and legal proceedings on social insurance as prescribed by law.

Hence, employees do not necessarily have to receive pensions directly from the social insurance agency but can do so through:

- An authorized service organization by the social insurance agency.- A bank account opened by the employee.- The employer.
