Responsibilities of the Peasant Assistance Fund of Vietnam after receiving a dissolution decision
Based on the provisions of Article 43 Decree 37/2023/ND-CP, the regulations are as follows:
Responsibilities of the Peasant Assistance Fund of Vietnam after receiving a dissolution decision
1. Immediately cease all fundraising, lending activities, and any related operations once the dissolution decision comes into effect.
2. Within 10 working days from the effective date of the dissolution decision, the Peasant Assistance Fund of Vietnam must:
a) Close the accounting books; inventory assets; reconcile receivables and payables; prepare financial statements up to the date the dissolution decision takes effect;
b) Prepare a list of the Fund's deposits at deposit-receiving organizations; a list of payables, including mobilized funds; a list of borrowers and the amount of principal and interest receivable (divided into recoverable and non-recoverable debts); a list of entrusted and received entrustments;
c) Submit a written request to the tax authority to confirm the Fund's tax obligations (if any).
3. Within 30 working days from the effective date of the dissolution decision, the Peasant Assistance Fund of Vietnam must hand over to the Dissolution Council:
a) Financial statements, accounting books, and documents related to the dissolution of the Peasant Assistance Fund of Vietnam; lists of loans, investments, entrusted and received entrustments of the Fund;
b) All assets under the lawful ownership, management, and use by the Peasant Assistance Fund of Vietnam (including unrecovered assets).
Upon the enactment of a dissolution decision, the Peasant Assistance Fund of Vietnam must adhere to the responsibilities as regulated above.

Based on the provisions of Article 9 Decree 37/2023/ND-CP, the regulations are as follows:
Organizational Structure of the Peasant Assistance Fund of Vietnam
1. The organizational structure of the Peasant Assistance Fund of Vietnam includes:
a) The Board of Management;
b) The Supervisory Board;
c) The Executive Board, comprising: Director, Deputy Directors, Chief Accountant, and support staff.
2. The authority to decide on the planning, appointment, re-appointment, resignation, dismissal, transfer, rotation, commendation, and discipline of the Fund's managers is as stipulated in Articles 10, 11, and 12 of this Decree, the charter on the organization and operation of the Fund, and the guiding documents of the Vietnam Farmer's Union (if any).
As stipulated above, the organizational structure of the Peasant Assistance Fund of Vietnam includes:
- The Board of Management;
- The Supervisory Board;
- The Executive Board.

9. Duties and powers of the Board of Management include:
a) Receive, manage, and use the funds of the Peasant Assistance Fund of Vietnam in accordance with the law and the Fund's charter; be accountable to the Executive Committee of the Farmer's Union at the same level for the performance of assigned duties and powers;
b) Develop annual, medium-term, and long-term operational and financial plans for the Peasant Assistance Fund of Vietnam, and submit them to the Executive Committee of the Farmer's Union at the same level for approval;
c) Issue or amend operational regulations and other internal regulations per the Fund's charter;
d) Supervise and inspect the Executive Board of the Peasant Assistance Fund of Vietnam in complying with legal policies and implementing the decisions of the Board of Management;
dd) Decide on the lending interest rates of the Peasant Assistance Fund of Vietnam for each period under the provisions of Article 16 of this Decree;
e) Approve loans, decide on fundraising methods, and handle risks within their authority;
g) Approve financial reports, distribute revenue-expenditure differences, and allocate annual funds of the Peasant Assistance Fund of Vietnam after receiving an appraisal from the Supervisory Board to present to the Executive Committee of the Farmer's Union at the same level for approval;
h) Propose the Executive Committee of the Farmer's Union at the same level to issue amendments and supplements to the Fund's charter;
i) Propose the Executive Committee of the Farmer's Union at the same level to approve the staffing plan for establishing the operational apparatus of the Peasant Assistance Fund of Vietnam;
k) Issue or amend the operational regulations and allocate tasks to members of the Peasant Assistance Fund of Vietnam's Board of Management;
l) Other duties and powers as stipulated in the Fund's charter.
The Board of Management of the Peasant Assistance Fund of Vietnam has the duties and powers as regulated above.
