How is the Process for Awarding Commemorative Medals at the People's Court implemented?

Based on Article 9 of the Regulations issued together with Decision 19/2018/QD-TANDTC-TDKT, the process for awarding Commemorative Medals at the People's Court is as follows:

- For Chief Justice, Deputy Chief Justice, and Justices of the Supreme People's Court: The Organizational and Personnel Department of the Supreme People's Court is responsible for reviewing and preparing the dossier to be sent to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) for consolidation and recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision.

- For individuals working at units under the Supreme People's Court; the Judicial Academy; High-level People's Courts; Central Military Courts; Provincial-level People's Courts: Based on the selection results of the Emulation and Commendation Conference of the unit or the basic Emulation and Commendation Council, the head of the unit prepares the dossier and recommends awarding the Commemorative Medal to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) for consolidation and recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision.

- For individuals working at District-level People's Courts and Regional Military Courts (Regional Military Courts report to the Military Court of the Military Region under its management):

Based on the selection results at the unit, the head of the unit prepares the dossier recommending the awarding of the Commemorative Medal to the basic Emulation and Commendation Council for consideration and submission to the head of the unit for awarding the Commemorative Medal according to regulations.

- For individuals who have retired or transferred to other jobs:

+ Individuals from units under the Supreme People's Court, the Judicial Academy, and High-level People's Courts: The Organizational and Personnel Department of the Supreme People's Court coordinates with the head of the unit to review, prepare the dossier, recommend awarding the Commemorative Medal to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) for consolidation, recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision;

+ Individuals from Provincial-level People's Courts, District-level People's Courts, and Military Courts at all levels: The Organization, Personnel, and Inspection Department and the Emulation and Commendation Department of the Provincial-level People's Court or the Organizational and Personnel Department of the Central Military Court review, prepare the dossier, and submit it to the head of the unit recommending awarding the Commemorative Medal to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) for consolidation, recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision.

- For other subjects:

Based on the results of merits, contributions, and cooperation in work with the People's Court, the head of the units within the People's Court prepares the dossier (according to the process) recommending the awarding of the Commemorative Medal to individuals and sends it to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) for consolidation, recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision.

- In special cases such as serving foreign affairs, achieving sudden outstanding achievements, etc., the Standing Committee of the Emulation and Commendation Council of the People's Court is responsible for proposing, preparing the dossier, and submitting it to the Chief Justice of the Supreme People's Court for a decision.

Based on the provisions of Article 10 of the Regulations issued together with Decision 19/2018/QD-TANDTC-TDKT, the dossier for recommending commendation in the form of a Commemorative Medal for the cause of the People's Court includes:

- Proposal for recommending the awarding of the Commemorative Medal.

- A list of brief profiles of the cases proposed for the awarding of the Commemorative Medal.

- Copies of commendation decisions related to the awarding of the Commemorative Medal.

- Summary of achievements and work process of the individual with the certification of the head of the unit proposing the award. For retired individuals, it is certified by the unit managing the staff before retirement.

(In case of valid reasons, if the individual proposed for the awarding of the Commemorative Medal cannot prepare the summary of achievements and work process, the proposing unit is responsible for declaring on their behalf).

- Other subjects are not required to prepare a summary of the work process and individual achievements. However, the proposing unit must prepare a summary of the merits and achievements of the individual proposed for the building and development of the People's Court's cause.

- For individuals who are Vietnamese overseas or foreigners, a recommendation and evaluation document from the functional unit of the People's Court is required.

- Copies of commendation decisions related to the awarding of the Commemorative Medal.

When is the timeframe for implementing the awarding of the Commemorative Medal?

Based on Article 11 of the Regulations issued together with Decision 19/2018/QD-TANDTC-TDKT, the timeframe for awarding the Commemorative Medal is as follows:

- In June each year, the heads of units under the Supreme People's Court, the Director of the Judicial Academy, the Chief Justice of the High-level People's Courts, the Chief Justice of the Central Military Court, and the Chief Justice of the Provincial-level People's Courts shall initiate the preparation of dossiers for cases meeting the criteria and conditions for recommending the awarding of the Commemorative Medal.

- The dossier recommending the awarding of the Commemorative Medal shall be sent to the Standing Committee of the Emulation and Commendation Council of the People's Court (via the Emulation and Commendation Department) before July 31 each year for consolidation, recommendation to the Emulation and Commendation Council of the People's Court for consideration and submission to the Chief Justice of the Supreme People's Court for a decision.

- Other individuals awarded the Commemorative Medal according to the decision of the Chief Justice of the Supreme People's Court are not governed by this regulation.
