What is needed in the preparation of bidding documents for online drug bidding?
According to Article 35 of Circular 08/2022/ND-CP, the bid solicitor shall prepare an E-bidding documents for online drug procurement, including the following contents:
- The contents of E-bidding documents performed on the webform include: Data sheet, Bid form, Joint venture agreement (if any), Schedule "Bid price and Table of scope of supply, delivery schedule and schedule" technical requirements of the drug”.
- The remaining contents of the E-bidding documents are prepared and attached by the bid solicitor on the System.
- The preparation of the E-bidding documents is based on the web forms mentioned at Point a, Clause 1 of this Article and the provisions of Circular No. 15/2019/TT-BYT. The evaluation of the E-bids must be based on the evaluation standards of the E-Proposals and other requirements in the E-bidding documents, the submitted E-bids, the documents explaining and clarifying the Contractor's E-bids to ensure the selection of contractors with sufficient capacity and experience, with feasible solutions to execute the bidding package.
- After making the E-HSMT, the bid solicitor prints the E-bidding documents and submits it to the investor for appraisal and approval. The bid solicitor is responsible for the consistency between the approved E-bidding documents content and the E-bidding documents on the System. In case there is a difference between the approved E-bidding documents content and the E-bidding documents on the System, the content on the System is the basis for making and evaluating the E-bids.
- E-bidding documents is released for free on the System. The bid solicitor may not issue paper copies of bidding documents to contractors, in case the bid solicitor issues paper copies to contractors, the paper copies are not valid for preparation and evaluation of bids. Bidding contractors must pay expenses as prescribed in Circular No. 06/2021/TT-BKHDT.
- In case it is necessary to amend the E-bidding documents, the bid solicitor shall log in and edit it directly on the System after obtaining the investor's approval of the content.
- In case there is a difference between the information in the attached file of the E-bidding documents issued on the System and the information in the webform, the information in the webform is the basis for making and evaluating the E-bids.
- Contractors make a bid price schedule according to the webform, commit that the contents of the bid form are generated by the System on the System, in the case of a joint venture, a joint venture will be implemented on the System. The remaining contents of the E-bids are attached by the contractor on the System. In case there is a discrepancy between the information on the web form and the information in the attached E-bids, the information on the webform is the basis for evaluating the E-bids.
- In case of inconsistency between the provisions of this Article, Form No. 7A, Form No. 7B issued together with this Circular and the remaining provisions of this Circular, the provisions of this Article and Form No. 7A, Form No. 7B issued together with this Circular.

How much does it cost for a contractor to participate in the online drug bidding?
According to Article 5 of Circular 06/2021/TT-BKHDT stipulating the types of costs on the online bidding system:
“Article 5. Fees for using services of all kinds
1. The cost of selecting contractors and investors on the System includes:
a) The registration fee to join the System (only one time payment when registering) is VND 550,000 (VAT included);
b) The cost of maintaining the name and capacity profile of contractors and investors on the System is VND 550,000 for one (01) year (VAT included). Contractors, investors pay this cost from the second year onwards after the year of registration to participate in the System;
c) Cost of bid submission is 330,000 VND for one (01) bidding package (VAT included); the cost of submitting a proposal is 220,000 VND for one (01) bidding package (VAT included);
d) The cost of the winning bidder is calculated at 0.022% of the winning bid, but the maximum is VND 2,200,000 (VAT included). For a bidding package divided into several parts or separate lots, the cost of the winning contractor shall be calculated according to the winning value of each separate part or lot;
dd) The cost of using the e-contract is calculated at 0.022% of the contract price, but the maximum is VND 2,200,000 (VAT included).
2. Expenses for posting information about bidding on the System, Procurement Newspaper:
a) The cost of posting notices of invitation for bids, notices of invitation for expression of interest, notices of invitation for pre-qualification is 330,000 VND for one (01) bidding package or one (01) project in one (01) language (inclusive). including value added tax);
b) The cost of posting notices of invitation to offer, short list is 165,000 VND for one (01) bidding package in one (01) language (VAT included).”
Thus, when participating in online drug bidding, the contractor must pay the costs as prescribed above.
What information is the name of the bidding package when participating in online drug bidding on the system?
Pursuant to Article 14 of Circular 15/2019/TT-BYT stipulating the name of the bidding package when participating in online drug bidding on the bidding system
Categorization of contract packages and drug categories shall follow the provisions from Article 7 to Article 12:
If a contract package is categorized into several parts, each of them shall have a suitable name. Specific information in contractor selection plan are as follows:
+ Each part in a contract package of generic drugs shall include: name of the active ingredient; content/concentration; route of administration, dosage form; category; measuring unit, quantity; unit price and total value;
+ Each part in a contract package of original branded name drugs or equivalent drugs shall include: name of the drug and the phrase “or equivalent drugs”; content/concentration; route of administration, dosage form; category; measuring unit, quantity; unit price and total value. If an active ingredient has several names of proprietary drug or equivalent drug or reference bioequivalence on the List of proprietary drug or equivalent drug or reference bioequivalence published by Ministry of Health, name of the drug shall include names of proprietary drug or equivalent drug or reference bioequivalence;
+ Each part in a contract package of herbal drugs or traditional drugs shall include: name of the drug; route of administration, dosage form; measuring unit; category; quantity; unit price and total value; Names of drugs shall be written complying with the provisions in Article 3 of this Decree.
+ Each part in a contract package of herbal ingredients or traditional ingredients shall include: name of the ingredient; scientific name; quality standards; raw form or processing method; category; measuring unit, quantity; unit price and total value.
Circular 08/2022/TT-BKHDT comes into force from August 1, 2022.
