According to Article 12 of the Law on Health Insurance 2008, amended by Clause 6, Article 1 of the Law on amendments to the Law on Health insurance 2014, it is stipulated that the persons receiving monthly compensation for loss of capacity for work is one of the subjects eligible for health insurance.

b) Persons receiving monthly retirement pensions and compensation for loss of capacity for work

In Article 2 of Decree 146/2018/ND-CP, regulations on group of health insurance policyholders whose contributions are paid by social insurance agencies are specifically as follows:

1. Persons eligible to be entitled to retirement pensions and incapacity benefits
2. Persons currently entitled to monthly social insurance benefits in connection with occupational accidents or diseases; rubber plantation workers currently entitled to monthly benefits in accordance with the Government’s regulations.
3. Employees on sick leaves in connection with diseases defined in the List of diseases of which long-term treatments are required, issued by the Ministry of Health.
4. Public officers of communes, wards or townlets who leave work and are currently entitled to monthly social insurance benefits.
5. Employees on parental leaves who are entitled to childbirth and adoption benefits.
6. Persons currently entitled to unemployment benefits.

Thus, according to the above regulations, persons receiving monthly compensation for loss of capacity are eligible for health insurance.

However, the contributions of the persons receiving monthly compensation for loss of capacity will be paid by social insurance agencies.

What are the allowances serving as a basis for health insurance premium payment for persons receiving monthly compensation for loss of capacity in Vietnam?

According to Article 14 of the Law on Health Insurance 2008 as amended by Clause 8, Article 1 of the Law on amendments to the Law on Health insurance 2014, regulations on salaries, remuneration, allowances serving as a basis for health insurance premium payment are specifically as follows:

1. Employees salaried under state regulations shall pay health insurance premiums based on their monthly salaries paid according to their ranks or grades, and position, extra-seniority or trade seniority allowances (if any).
2. Employees salaried or remunerated according to their employers’ regulations shall pay social insurance premiums based on their monthly salaries or remunerations indicated in their labor contracts.
3. Persons on monthly pension, working capacity loss allowance or job-loss allowance shall pay health insurance premiums based on their monthly pensions, working capacity loss allowances or job-loss allowances.
4. With regard to other insured, their premiums shall be paid according to their base salaries.
5. The premiums shall be paid according to the monthly salaries that must not exceed 20 times base salaries.

Thus, according to the above regulations, the social insurance agency pays health insurance for the persons receiving monthly compensation for loss of capacity based on their monthly pensions, working capacity loss allowances or job-loss allowances.

How much is the contribution rate for persons receiving monthly compensation for loss of capacity in Vietnam?

Pursuant to Article 7 of Decree 146/2018/ND-CP regulating health insurance premiums and responsibilities as follows:

1. Monthly health insurance contribution rates shall be subject to the following regulations:
a) The contribution rate shall be equal to 4.5% of the employee’s monthly pay with respect to those policyholders specified in clause 1, Article 1 of this Decree.
- Employees on sick leaves from at least 14 days per a month in accordance with laws on social insurance shall not be required to pay health insurance contributions and shall be entitled to health insurance benefits;
- With respect to employees that are detained, held in custody or suspended from work for investigations, consideration of judgement whether they have committed violations against laws, the monthly contribution rate shall be defined as 4.5% of 50% of each employee's monthly pay. In case where a competent authority makes its judgement that none of violations has been committed, the employee shall be required to pay health insurance contributions in proportion to the accrued pay amount that he/she has received;
b) The contribution rate shall be equal to 4.5% of the retirement pension and incapacity benefit with respect to those policyholders specified in clause 1, Article 2 of this Decree;
c) The contribution rate shall be equal to 4.5% of the monthly pay that an employee receives before his/her pregnancy and parental leave with respect to those policyholders specified in clause 5, Article 2 of this Decree;
d) The contribution rate shall be equal to 4.5% of the unemployment benefit with respect to those policyholders specified in clause 6, Article 2 of this Decree;
dd) The contribution rate shall be equal to 4.5% of the base pay rate with respect to those policyholders other than the abovementioned;
