National Technical Regulation QCVN 01:2022/BKHCN on Gasoline, Diesel Fuel, and Biofuels Effective from February 1, 2023, What Are the Provisions?
On December 15, 2022, the Ministry of Science and Technology issued the National Technical Regulation QCVN 01:2022/BKHCN on Gasoline, Diesel Fuel, and Biofuels.
The scope of adjustment for the National Technical Regulation QCVN 01:2022/BKHCN is as follows:
- This technical regulation stipulates the limit levels for technical indicators related to safety: health, environment, and quality management requirements for various types of gasoline, diesel fuel, and biofuels, including:
+ Unleaded gasoline, E5 gasoline, E10 gasoline;
+ Diesel fuel, B5 diesel fuel;
+ Base biofuels: Untreated ethanol fuel, denatured ethanol fuel, and B100 base biodiesel fuel.
+ The fuels in this technical regulation have HS codes specified in the List of Vietnam's Export and Import Goods issued by the Ministry of Finance, accompanied by Circular No. 31/2022/TT-BTC dated June 8, 2022 (see Appendix A).
- This technical regulation does not apply to fuels used in the aviation sector and for defense purposes.

How are the HS Codes for Gasoline and Diesel Fuel Specified?
In Appendix A issued with the National Technical Regulation QCVN 01:2022/BKHCN, the HS codes for gasoline and diesel fuel are specified as follows:
What Are the Responsibilities of Organizations and Individuals Regarding Gasoline, Diesel Fuel, and Biofuels?
In Section 5 of the National Technical Regulation QCVN 01:2022/BKHCN, the responsibilities of organizations and individuals regarding gasoline, diesel fuel, and biofuels are specified as follows:
- Organizations and individuals producing, blending, and importing unleaded gasoline, E5 gasoline, E10 gasoline, diesel fuel, B5 diesel fuel, denatured ethanol fuel, untreated ethanol fuel, and base biodiesel fuel must declare applicable standards with content not contrary to this technical regulation, ensuring the quality complies with the provisions of this technical regulation and the declared applicable standards.
- Organizations and individuals producing, blending unleaded gasoline, E5 gasoline, E10 gasoline, diesel fuel, B5 diesel fuel, denatured ethanol fuel, untreated ethanol fuel, and base biodiesel fuel must carry out conformity certification and declare conformity according to the provisions of this technical regulation.
Organizations and individuals importing unleaded gasoline, E5 gasoline, E10 gasoline, diesel fuel, B5 diesel fuel, denatured ethanol fuel, untreated ethanol fuel, and base biodiesel fuel must carry out conformity certification in accordance with this technical regulation and register for state quality inspection of imported goods according to the provisions of this technical regulation.
- Organizations and individuals distributing and retailing unleaded gasoline, E5 gasoline, E10 gasoline, diesel fuel, B5 diesel fuel, denatured ethanol fuel, untreated ethanol fuel, and base biodiesel fuel must ensure the quality aligns with the provisions of this technical regulation.
- Designated certification and testing organizations must perform responsibilities as stipulated in Article 18 of Decree No. 132/2008/ND-CP, amended and supplemented in Clause 8 Article 1 of Decree No. 74/2018/ND-CP dated May 15, 2018, of the Government of Vietnam.
+ Certification and testing organizations, and related organizations and individuals must maintain records according to the provisions of Circular No. 19/2019/TT-BKHCN dated December 10, 2019, by the Minister of Science and Technology, regulating the preservation period of specialized science and technology records and documents. Specifically:
++ For testing records and documents on gasoline, diesel fuel, and biofuels, it is 05 years;++ For certification records and documents on gasoline, diesel fuel, and biofuels, it is 10 years.
- At fuel stations or retail stores, or other distribution and retail vehicles, the type of gasoline and/or diesel fuel must be clearly indicated with the following information:
+ For unleaded gasoline: octane rating and quality level appropriate to emission standards;
+ For biofuels: octane rating, ethanol fuel blending ratio, and quality level appropriate to emission standards;
+ For diesel fuel: sulfur content;
+ For B5 diesel fuel: base biodiesel fuel ratio and sulfur content.
The National Technical Regulation QCVN 01:2022/BKHCN will be effective from February 1, 2023.
