The dossier for requesting reissuance of a lost Land Use Rights Certificate?

According to Clause 2, Article 10 of Circular 24/2014/TT-BTNMT, the documents to be submitted when carrying out the procedure for reissuing the Certificate, the Certificate of House Ownership, or the Certificate of Construction Works Ownership due to loss include:

- An application for reissuance of the Certificate according to Form No. 10/DK;

- A certification from the Commune People's Committee on the posting of a notice of the lost certificate for 15 days for households and individuals; documents proving that the loss notice has been published three times in local mass media for organizations, religious establishments, foreign individuals, foreign organizations with diplomatic functions, foreign-invested enterprises, and overseas Vietnamese implementing investment projects. In cases where the Certificate is lost due to natural disasters or fire, a certification from the Commune People's Committee about the natural disaster or fire is required.

Procedures for reissuing a lost Land Use Rights Certificate?

According to Article 77 of Decree 43/2014/ND-CP, the procedures for reissuing the certificate, the Certificate of House Ownership, and the Certificate of Construction Works Ownership due to loss are as follows:

- Households, individuals, and residential communities must report to the Commune People's Committee where the land is located about the loss of the Certificate, the Certificate of House Ownership, or the Certificate of Construction Works Ownership. The Commune People's Committee is responsible for posting a notice of the lost Certificate at the Commune People's Committee office, except in cases where the certificate is lost due to natural disasters or fire.

Domestic organizations, religious establishments, foreign organizations, foreign individuals, overseas Vietnamese must publish a loss notice of the Certificate, the Certificate of House Ownership, or the Certificate of Construction Works Ownership in local mass media.

- After 30 days from the date of posting the notice of the lost Certificate at the Commune People's Committee office for households, individuals, residential communities, or from the date of the first publication in local mass media for domestic organizations, religious establishments, foreign organizations, foreign individuals, overseas Vietnamese, the person who lost the Certificate may submit one set of documents requesting reissuance of the Certificate.

- The Land Registration Office is responsible for checking the documents; extracting the cadastral map or measuring the cadastral parcel for cases without a cadastral map and measuring the cadastral parcel; compiling a dossier to submit to the competent authorities as stipulated in Article 37 of this Decree to sign the decision to cancel the lost Certificate, concurrently re-issuing the Land Use Rights Certificate, House Ownership Certificate, and other assets attached to the land; updating and correcting changes in the cadastral dossier, and land database; delivering the issued Certificate to the applicant or sending it to the Commune People's Committee for delivery in the case of documents submitted at the commune level.

Upon discovering the loss of the Land Use Rights Certificate, the individual must immediately notify the Commune People's Committee where the land is located to conduct the posting of the lost Certificate notice.

Within 30 days from the notice posting date, the individual who lost the Land Use Rights Certificate must submit a dossier requesting reissuance of the Land Use Rights Certificate.

Subsequently, the Land Registration Office will verify the information, submit it to the competent authorities to sign the decision to cancel the lost Land Use Rights Certificate, and concurrently reissue a new Land Use Certificate.
